Section
1.
Section
29A.43,
subsection
1,
Code
2011,
is
1
amended
to
read
as
follows:
2
1.
A
person
shall
not
discriminate
against
any
officer
or
3
enlisted
person
of
the
national
guard
or
organized
reserves
4
of
the
armed
forces
of
the
United
States
or
any
member
of
the
5
civil
air
patrol
because
of
that
membership.
An
employer
or
6
prospective
employer
shall
not
discriminate
against
any
officer
7
or
enlisted
person
of
the
national
guard
or
organized
reserves
8
of
the
armed
forces
of
the
United
States
or
any
member
of
the
9
civil
air
patrol
in
hiring,
initial
employment,
employment,
or
10
reemployment
because
of
that
membership.
An
employer,
or
agent
11
of
an
employer,
shall
not
discharge
a
person
from
employment
12
because
of
being
an
officer
or
enlisted
person
of
the
military
13
forces
of
the
state
or
member
of
the
civil
air
patrol,
or
14
hinder
or
prevent
the
officer
or
enlisted
person
or
member
of
15
the
civil
air
patrol
from
performing
any
military
service
or
16
civil
air
patrol
duty
the
person
is
called
upon
to
perform
by
17
proper
authority.
A
member
of
the
national
guard
or
organized
18
reserves
of
the
armed
forces
of
the
United
States
ordered
to
19
temporary
duty,
as
defined
in
section
29A.1,
subsection
3,
11,
20
or
12
,
or
a
member
of
the
civil
air
patrol
performing
duty
21
pursuant
to
section
29A.3A
,
for
any
purpose
is
entitled
to
a
22
leave
of
absence
during
the
period
of
the
duty
or
service,
from
23
the
member’s
private
employment
unless
the
employment
is
of
a
24
temporary
nature.
Upon
completion
of
the
duty
or
service,
the
25
employer
shall
restore
the
person
to
the
position
held
prior
to
26
the
leave
of
absence
or
employ
the
person
in
a
position
of
like
27
seniority,
status,
and
pay.
However,
the
person
shall
give
28
evidence
to
the
employer
of
satisfactory
completion
of
the
duty
29
or
service,
and
that
the
person
is
still
qualified
to
perform
30
the
duties
of
the
position.
The
period
of
absence
shall
be
31
construed
as
an
absence
with
leave,
and
shall
in
no
way
affect
32
the
employee’s
rights
to
vacation,
sick
leave,
bonus,
or
other
33
employment
benefits
relating
to
the
employee’s
particular
34
employment.

EXPLANATION

This
bill
specifies
that
an
employer
or
prospective
employer

or
enlisted
person
of

or
organized
reserves
of
the
armed
forces

the
United
States
or
any
member
of
the
civil
air
patrol
in

hiring,
initial
employment,
employment,
or
reemployment
because

of
that
membership.
