H.F. 572 Section 1. Section 97B.11, subsection 2, unnumbered 1 paragraph 1, Code 2011, is amended to read as follows: 2 Prior to July 1, 2011 2012 , for purposes of this section , 3 unless the context otherwise requires: 4 Sec. 2. Section 97B.11, subsection 2, paragraph c, Code 5 2011, is amended to read as follows: 6 c. “Total additional percentage” means for the fiscal period 7 beginning July 1, 2007, through June 30, 2011 2012 , the total 8 additional percentage for the prior fiscal year plus, only if 9 the total comparison percentage is greater than the total of 10 the applicable employee percentage and the applicable employer 11 percentage for the prior fiscal year, one-half percentage 12 point. 13 Sec. 3. Section 97B.11, subsection 3, unnumbered paragraph 14 1, Code 2011, is amended to read as follows: 15 On and after July 1, 2011 2012 , for purposes of this section , 16 unless the context otherwise requires: 17 Sec. 4. 2008 Iowa Acts, chapter 1171, section 47, as amended 18 by 2010 Iowa Acts, chapter 1167, section 35, is amended to read 19 as follows: 20 SEC. 47. TRANSITION PROVISION —— REQUIRED CONTRIBUTION RATE 21 FOR FISCAL YEAR YEARS 2010-2011 AND 2011-2012 . For purposes 22 of establishing the required contribution rate for the fiscal 23 year beginning July 1, 2011 2012 , as provided in section 24 97B.11 , as amended in this Act, the required contribution 25 rate for the fiscal year beginning July 1, 2010, and the 26 fiscal year beginning July 1, 2011, shall be, for members 27 described in section 97B.49B , and members described in section 28 97B.49C , the total contribution percentage rate paid by members 29 and employers of that membership group for the fiscal year 30 beginning July 1, 2010 , and the fiscal year beginning July 1, 31 2011 . 32 Sec. 5. 2010 Iowa Acts, chapter 1167, section 38, is amended 33 to read as follows: 34 SEC. 38. H.F. 572 RATE FOR FISCAL YEAR 2011-2012 2012–2013 . Notwithstanding 1 any provision of section 97B.11 to the contrary, for members 2 in regular service as defined in section 97B.1A , the required 3 contribution rate for the fiscal year beginning July 1, 2011 4 2012 , as provided in section 97B.11 , shall be thirteen and 5 forty-five hundredths percent. 6 EXPLANATION 7 This bill delays for a period of one year statutory changes 8 that alter the contribution rates of employees and employers 9 contributing to the Iowa public employees’ retirement system. 10 Statutory changes relating to contribution rates that are set 11 to take effect on July 1, 2011, would instead take effect on 12 July 1, 2012. 13 -2- LSB 2704HV (1) 84 aw/sc 2/ 2
