1.
Section
403A.3,
subsection
8,
Code
2011,
is

amended
to
read
as
follows:

8.
To,
within
its
area
of
operation,
enter
into
any
building

or
property
in
any
municipal
housing
area
in
order
to
make

inspections,
surveys,
appraisals,
soundings
,
or
test
borings,
5
unless
such
property
is
exempt
from
inspection
and
regulation
6
under
section
403A.11,
and
to
obtain
an
order
for
this
purpose
7
from
a
court
of
competent
jurisdiction
in
the
event
entry
is
8
denied
or
resisted.

2.
Section
403A.11,
Code
2011,
is
amended
to
read
as
10
follows:

Planning,
zoning
and
building
laws
——
insulation
12
requirements.

1.
All
housing
projects
of
a
municipality
shall
be
subject
14
to
the
planning
,
and
zoning
,
sanitary
and
building
laws,
15
ordinances
and
regulations
applicable
to
the
locality
in
which
16
the
project
is
situated.
Such
housing
projects,
however,
17
shall
be
exempt
from
sanitary
and
building
laws,
ordinances,
18
and
regulations,
including
any
inspections
resulting
from
such
19
laws,
ordinances,
and
regulations,
applicable
to
the
locality
20
in
which
the
project
is
situated.

2.
a.
All
Notwithstanding
the
exemption
from
certain
22
sanitary
and
building
laws,
ordinances,
and
regulations
23
under
subsection
1,
all
dwellings
which
are
part
of
housing
24
projects
and
which
are
proposed
to
be
rented
to
low-income
25
families
or
the
elderly
through
the
programs
of
the
United
26
States
department
of
housing
and
urban
development
shall
have
27
ceiling
insulation
having
an
R
value
of
38
in
the
attic,
28
floor
insulation
having
an
R
value
of
20,
or
perimeter
wall
29
insulation
having
an
R
value
of
10
beneath
all
habitable
30
heated
areas
or
over
unheated
spaces.
In
addition,
basement
31
walls
shall
have
insulation
with
an
R
value
of
6
to
their
full
32
height,
with
insulation
in
the
box
sill
having
an
R
value
of
33
20.
As
used
in
this
section
,
“R
value”
means
resistance
to
heat
34
flow.

The
insulation
requirements
of
this
section
are
effective
1
for
all
dwellings,
the
construction
of
which
begins
on
or
after
2
July
1,
1991.
For
dwellings
existing
or
under
construction
3
prior
to
July
1,
1991,
the
dwelling
must
comply
with
the
4
insulation
requirements
of
this
section
by
June
30,
1996.

EXPLANATION
6
This
bill
exempts
municipal
housing
projects
from
sanitary
7
and
building
laws,
ordinances,
and
regulations,
including
8
any
inspections
resulting
from
such
laws,
ordinances,
and
9
regulations,
applicable
to
the
locality
in
which
the
project
10
is
situated.
