H.F. 497 Section 1. Section 249A.15A, Code 2011, is amended to read 1 as follows: 2 249A.15A Licensed marital and family therapists and , licensed 3 master social workers , and licensed mental health counselors . 4 1. The department shall adopt rules pursuant to chapter 5 17A entitling marital and family therapists who are licensed 6 pursuant to chapter 154D to payment for behavioral health 7 services provided to recipients of medical assistance, subject 8 to limitations and exclusions the department finds necessary on 9 the basis of federal laws and regulations. 10 2. The department shall adopt rules pursuant to chapter 11 17A entitling master social workers who hold a master’s 12 degree approved by the board of social work, are licensed as 13 a master social worker pursuant to section 154C.3, subsection 14 1 , paragraph “b” , and provide treatment services under the 15 supervision of an independent social worker licensed pursuant 16 to section 154C.3, subsection 1 , paragraph “c” , to payment 17 for behavioral health services provided to recipients of 18 medical assistance, subject to limitations and exclusions the 19 department finds necessary on the basis of federal laws and 20 regulations. 21 3. The department shall adopt rules pursuant to chapter 17A 22 entitling mental health counselors who are licensed pursuant to 23 chapter 154D to payment for behavioral health services provided 24 to recipients of medical assistance, subject to limitations 25 and exclusions the department finds necessary on the basis of 26 federal laws and regulations. 27 4. The department shall adopt rules pursuant to chapter 17A 28 entitling alcohol and drug counselors who are certified by the 29 nongovernmental Iowa board of substance abuse certification to 30 payment for behavioral health services provided to recipients 31 of medical assistance, subject to limitations and exclusions 32 the department finds necessary on the basis of federal laws and 33 regulations. 34 Sec. 2. MEDICAL ASSISTANCE STATE PLAN —— MENTAL HEALTH 35 -1- LSB 2291HV (2) 84 pf/nh 1/ 2

The department of human services shall amend the 1 medical assistance state plan to allow mental health counselors 2 licensed in the state and alcohol and drug counselors certified 3 in the state to be participating behavioral health providers 4 under the medical assistance program. 5 EXPLANATION 6 This bill directs the department of human services (DHS) to 7 adopt rules entitling licensed mental health counselors and 8 certified alcohol and drug counselors to payment for behavioral 9 health services provided to recipients of medical assistance, 10 subject to limitations and exclusions the department finds 11 necessary on the basis of federal laws and regulations. The 12 bill also directs DHS to amend the Medicaid state plan to allow 13 licensed mental health counselors and certified alcohol and 14 drug counselors to be participating behavioral health providers 15 under the Medicaid program. 16 -2- LSB 2291HV (2) 84 pf/nh 2/ 2
