Section
1.
Section
400.1,
subsection
1,
Code
2011,
is
1
amended
to
read
as
follows:

1.
In
cities
having
a
population
of
eight
thousand
or
over
3
and
having
a
paid
fire
department
or
a
paid
police
department,
4
the
mayor,
one
year
after
a
regular
city
election,
with
the
5
approval
of
the
council,
shall
may
appoint
three
civil
service
6
commissioners.
The

such
appointments
are
made,
the
mayor
7
shall
publish
notice
of
the
names
of
persons
selected
for
8
appointment
no
less
than
thirty
days
prior
to
a
vote
by
the
9
city
council.
Commissioners
shall
hold
office,
one
until
the
10
first
Monday
in
April
of
the
second
year,
one
until
the
first
11
Monday
in
April
of
the
third
year,
and
one
until
the
first
12
Monday
in
April
of
the
fourth
year
after
such
appointment,

whose
successors
shall
be
appointed
for
a
term
of
four
years.

In
cities
having
a
population
of
more
than
seventy
thousand,

the
city
council
may
establish,
by
ordinance,
the
number
of
16
civil
service
commissioners
at
not
less
than
three.

Section
400.1,
subsection
2,
Code
2011,
is
amended

to
read
as
follows:

the
purpose
of
determining
the
population
of
a
city

under
this
chapter
,
the
most
recent
decennial
federal
census

conducted
in
1980
shall
be
used.

IMPLEMENTATION
OF
ACT.
Section
25B.2,
subsection

shall
not
apply
to
this
Act.

EXPLANATION
25
Code
section
400.1
currently
requires
a
city
having
a

population
of
8,000
or
more
according
to
the
federal
census

conducted
in
1980
and
having
a
paid
fire
department
or
a
paid

police
department,
to
appoint
a
civil
service
commission.
Code

chapter
400
also
establishes
several
other
powers
and
duties
of

cities
based
on
population
as
determined
by
the
federal
census

conducted
in
1980.

This
bill
requires
the
most
recent
decennial
federal
census

to
be
used
in
determining
the
population
of
a
city.

bill
also
makes
the
appointment
of

bill
makes
inapplicable
Code
section
25B.2,
subsection
3
3,
which
would
relieve
a
political
subdivision
from
complying

with
a
state
mandate
if
funding
for
the
cost
of
the
state
5
mandate
is
not
provided
or
specified.
Therefore,
political
6
subdivisions
are
required
to
comply
with
any
state
mandate
7
included
in
the
bill.
