H.F. 426 Section 1. Section 260C.14, Code 2011, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 23. Adopt rules to waive tuition and 3 mandatory fee charges for any student in good standing who is 4 a resident of Iowa; is under the age of twenty-six, or under 5 the age of thirty if the student is a qualified veteran as 6 defined in subsection 14; is not a convicted felon as defined 7 in section 910.15; and meets the following criteria: 8 a. Is the child of a peace officer, as defined in section 9 97A.1, who receives benefits under section 97A.6, subsection 10 5, or was killed in the line of duty as determined by the 11 board of trustees of the Iowa department of public safety 12 peace officers’ retirement, accident, and disability system in 13 accordance with section 97A.6, subsection 16. 14 b. Is the child of a police officer or a fire fighter, as 15 defined in section 411.1, who receives benefits under section 16 411.6, subsection 5, or was killed in the line of duty as 17 determined by the statewide fire and police retirement system 18 in accordance with section 411.6, subsection 15. 19 Sec. 2. Section 262.9, Code 2011, is amended by adding the 20 following new subsection: 21 NEW SUBSECTION . 36. Adopt rules that require the 22 institutions of higher education under its control to waive 23 tuition and mandatory fee charges for any undergraduate student 24 in good standing who is a resident of Iowa; is under the age 25 of twenty-six, or under the age of thirty if the student is 26 a qualified veteran as defined in subsection 17; is not a 27 convicted felon as defined in section 910.15; and meets the 28 following criteria: 29 a. Is the child of a peace officer, as defined in section 30 97A.1, who receives benefits under section 97A.6, subsection 31 5, or was killed in the line of duty as determined by the 32 board of trustees of the Iowa department of public safety 33 peace officers’ retirement, accident, and disability system in 34 accordance with section 97A.6, subsection 16. 35 -1- LSB 2621YH (2) 84 kh/sc 1/ 2

Is the child of a police officer or a fire fighter, as 1 defined in section 411.1, who receives benefits under section 2 411.6, subsection 5, or was killed in the line of duty as 3 determined by the statewide fire and police retirement system 4 in accordance with section 411.6, subsection 15. 5 Sec. 3. IMPLEMENTATION OF ACT. Section 25B.2, subsection 6 3, shall not apply to this Act. 7 EXPLANATION 8 This bill directs the community colleges and regents 9 universities to waive tuition and mandatory fee charges for 10 any undergraduate student in good standing who is a resident 11 of Iowa; is under the age of 26, or 30 if the student is a 12 veteran who is eligible for or has exhausted federal veterans 13 educational benefits and has resided in this state for at least 14 one year or sufficient time to have filed an Iowa tax return in 15 the preceding 12 months; is not a convicted felon; and is the 16 child of a peace officer, police officer, or fire fighter who 17 receives accidental disability benefits or who was killed in 18 the line of duty. 19 The bill may include a state mandate as defined in Code 20 section 25B.3. The bill makes inapplicable Code section 25B.2, 21 subsection 3, which would relieve a political subdivision from 22 complying with a state mandate if funding for the cost of 23 the state mandate is not provided or specified.
