H.F. 401 Section 1. Section 85.61, subsection 7, Code 2011, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . c. Personal injuries sustained by an 3 employee which occur on an employer’s premises are not 4 incidental to the employee’s employment and do not arise out of 5 and in the course of employment if the injuries are sustained 6 during nonwork hours while the employee is on a personal errand 7 to those premises. 8 EXPLANATION 9 This bill provides that a personal injury arising out of 10 and in the course of employment which would be compensable 11 under the state’s workers’ compensation laws does not include a 12 personal injury sustained by an employee while on an employer’s 13 premises if the injury is sustained during nonwork hours while 14 the employee is on a personal errand to those premises. 15 -1- LSB 1903HV (1) 84 av/nh 1/ 1
