H.F. 362 Section 1. Section 321.449, Code 2011, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 7A. Rules adopted under this section 3 concerning the marking of commercial motor vehicles shall not 4 apply to a commercial motor vehicle owned or controlled by a 5 farmer and operated intrastate to transport the farmer’s own 6 agricultural products, farm machinery, or farm supplies to or 7 from the farm or, if the farmer assists other farmers through 8 an exchange of services, between the farms of the farmers who 9 are exchanging services. 10 EXPLANATION 11 Pursuant to current law, the department of transportation 12 has adopted administrative rules for the regulation of 13 commercial vehicles which are consistent with federal motor 14 carrier safety regulations. Those rules require certain 15 commercial motor vehicles to display a U.S. department of 16 transportation number on the vehicle, a practice known as 17 “marking”. 18 This bill provides an exemption from marking requirements 19 for commercial motor vehicles which are owned or controlled 20 by a farmer and operated intrastate to transport agricultural 21 products, farm machinery, or farm supplies to or from the farm. 22 Vehicles operated between farms by farmers who assist each 23 other through an exchange of services are included under the 24 exemption. 25 -1- LSB 2094YH (2) 84 dea/nh 1/ 1
