Section
1.
Section
20.6,
Code
2011,
is
amended
by
adding
the
1
following
new
subsection:

NEW
SUBSECTION
.
4A.
Establish
and
collect
fees
payable
by
a
3
person
or
entity
accessing
one
or
more
services
available
from
4
or
through
the
board.
The
board
may
charge
a
person
or
entity
5
a
fee
for
accessing
the
services
of
the
federal
mediation
6
and
conciliation
service
through
the
board
if
the
person
or
7
entity
does
not
otherwise
have
a
right
to
directly
access
such
8
services,
unless
otherwise
prohibited
by
federal
law.
The
9
board
shall
only
establish
and
collect
fees
necessary
for
the
10
board
to
continue
offering
services
required
by
this
chapter.

A
fee
shall
not
exceed
the
cost
of
the
service
associated
12
with
the
fee.
The
board
shall
not
establish
a
fee
which
13
would
significantly
impair
the
accessibility
of
any
service
14
provided
by
the
board.
All
fees
collected
by
the
board
shall
15
be
retained
as
repayment
receipts,
as
defined
in
section
8.2,
16
and
such
fees
shall
be
used
exclusively
to
offset
the
costs
of
17
administering
this
chapter.

EXPLANATION
19
This
bill
provides
that
the
public
employment
relations
20
board
has
the
power
to
establish
and
collect
fees
payable
by
21
a
person
or
entity
accessing
one
or
more
services
available
22
from
or
through
the
board.
The
bill
provides
that
the
board
23
may
charge
a
person
or
entity
a
fee
for
accessing
the
services
24
of
the
federal
mediation
and
conciliation
service
through
25
the
board
if
the
person
or
entity
does
not
otherwise
have
26
a
right
to
directly
access
such
services,
unless
otherwise
27
prohibited
by
federal
law.
The
bill
provides
that
the
board
28
can
only
establish
and
collect
fees
necessary
for
the
board
29
to
continue
offering
services
required
by
Code
chapter
20.
30
The
bill
specifies
that
a
fee
cannot
exceed
the
cost
of
the
31
service
associated
with
the
fee
or
significantly
impair
the
32
accessibility
of
any
service
provided
by
the
board.
The
bill
33
provides
that
fees
collected
by
the
board
shall
be
retained
as
34
repayment
receipts
to
be
used
by
the
board
to
offset
the
costs
