H.F. 324 Section 1. NEW SECTION . 7E.8 Implementation of federal 1 statute, regulation, or policy. 2 1. Except as otherwise explicitly authorized by state law, a 3 state administrative agency charged with the implementation of 4 a federal statute, regulation, or policy shall not exceed the 5 specific requirements of that statute, regulation, or policy. 6 2. Any portion of a state administrative agency rule or 7 policy that is in violation of subsection 1 is void. 8 EXPLANATION 9 This bill provides that state implementation of a federal 10 statute, regulation, or policy by a state administrative 11 agency shall not exceed the specific requirements of the 12 federal statute, regulation, or policy, except as specifically 13 allowed by state law.
