Section 455B.265, subsection 6, Code 2011, is 3 amended by striking the subsection. 4 Sec. 3. REPEAL. Section 455B.265A, Code 2011, is repealed. 5 Sec. 4. EMERGENCY RULES. The department of natural 6 resources may adopt emergency rules under section 17A.4, 7 subsection 3, and section 17A.5, subsection 2, paragraph “b”, 8 to adopt water use permit fees that were in effect prior to the 9 enactment of 2008 Iowa Acts, chapter 1163, and the rules shall 10 be effective immediately upon filing unless a later date is 11 specified in the rules. Any rules adopted in accordance with 12 this section shall also be published as a notice of intended 13 action as provided in section 17A.4. 14 EXPLANATION 15 This bill repeals water use permit fees and the water use 16 permit fund that were enacted pursuant to 2008 Iowa Acts, 17 chapter 1163. 18 The bill eliminates a sales tax exemption for water use 19 permit fees paid. 20 The bill eliminates fee provisions relating to fees charged 21 for certain water use permits. 22 The bill repeals Code section 455B.265A, relating to the 23 establishment of the water use permit fund and the associated 24 standing appropriation. 25 The bill allows the department to adopt water use permit fees 26 that were in effect prior to the enactment of 2008 Iowa Acts, 27 chapter 1163, through the use of emergency rules. 28 -1- LSB 1272YH (4) 84 tm/nh 1/ 1
