H.F. 308 Section 1. NEW SECTION . 135.75A Data reporting on 1 circulating nurse in operating room. 2 1. a. A hospital or outpatient surgical facility, as 3 defined in section 135.61, shall keep written records regarding 4 the use of circulating nurses in each separate operating room 5 where surgery is being performed. 6 b. For purposes of this section, “circulating nurse” means 7 a registered nurse, qualified by training and experience 8 in operating room nursing, who is present in an operating 9 room where surgery is being performed for the duration of 10 the operative procedure. Instances of a circulating nurse 11 leaving the operating room as part of the operative procedure, 12 leaving the operating room for short periods or, in accordance 13 with employer rules or regulations, being relieved during an 14 operative procedure by another circulating nurse assigned to 15 continue the operative procedure shall not disqualify the nurse 16 from being a circulating nurse. 17 2. The data collected pursuant to subsection 1 shall be 18 made available to the public at least annually. A circulating 19 nurse shall assist the administration of the nurse’s employing 20 facility in complying with this section. 21 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 22 immediate importance, takes effect upon enactment. 23 EXPLANATION 24 This bill requires the collection and public reporting 25 of patient safety data regarding hospitals’ and outpatient 26 surgical facilities’ use of a registered nurse in the role of 27 a circulator that is present to assure quality care of the 28 patient during surgery. 29 -1- LSB 1814YH (1) 84 jr/nh 1/ 1
