Section
1.
Section
256.7,
Code
2011,
is
amended
by
adding
1
the
following
new
subsection:

SUBSECTION
.
31.
Adopt
rules
specifically
defining
the

amount
of
state
aid
to
be
withheld
from
a
school
district
for
4
a
violation
of
section
279.65.
5
Sec.
2.
Section
256.9,
subsection
52,
Code
2011,
is
amended
6
to
read
as
follows:

52.
Establish
and
maintain
a
process
and
a
procedure,
in
8
cooperation
with
the
board
of
educational
examiners,
to
compare
9
a
practitioner’s
teaching
assignment
with
the
license
and
10
endorsements
held
by
the
practitioner.
The
director
may
report
11
noncompliance
issues
identified
by
this
process
to
the
board
of
12
educational
examiners
pursuant
to
section
272.15,
subsection
13
3
,
and
may
provide
for
the
withholding
of
state
aid
to
a
school
14
district
if
the
department
determines
that
the
school
district
15
has
inappropriately
assigned
a
teacher
in
violation
of
section
16
279.65,
subsection
4
.

3.
NEW
SECTION
.
279.65
Teacher
of
record
——
contact
18
hours
and
endorsements
——
student
advancement.

1.
The
state
board
of
education
shall
define
the
term
20
“teacher
of
record”
by
rule.
The
definition
shall
provide,
21
at
a
minimum,
that
the
term
identifies
the
teacher
who
has
22
responsibility
for
providing
instruction
to
a
given
student
for
23
a
given
subject
during
each
semester.
A
student
may
have
more
24
than
one
teacher
of
record
if
the
school
district
utilizes
team
25
teaching
in
a
given
subject
or
when
another
teacher
provides
26
supplemental
instruction.
The
state
board
of
education
shall
27
determine
under
the
definition
the
share
of
instructional
28
responsibility
to
be
apportioned
to
each
teacher
of
a
subject
29
or
grade
level.
The
definition
shall
establish
guidelines
30
for
determining
whether
a
teacher
of
record
is
a
classroom
31
instructor
or
provides
supplemental
education
in
a
subject.

At
least
twice
annually,
a
teacher
of
record
and
the
33
teacher’s
supervisor
shall
verify
and,
where
appropriate,
34
correct
the
roster
of
students
for
whom
the
teacher
has
been
35

assigned
responsibility.
The
teacher
of
record
shall
have
1
at
least
fifty
percent
of
the
total
contact
hours
with
a
2
given
student
in
a
given
subject,
except
when
the
coursework

is
offered
as
an
advanced
placement
class
or
as
online
4
postsecondary-level
coursework.

A
student
shall
not
advance
to
the
next
grade
level
or
6
the
next
level
of
coursework
unless
the
student
demonstrates
7
proficiency
by
successfully
meeting
the
minimum
course
8
requirements
which
shall
be
equally
administered
for
all
9
students
as
demonstrated
by
the
teacher
of
record’s
published
10
standards
for
competency
and
proficiency
for
the
grade
level
11
or
course
or
by
the
school
district’s
published
standards
for
12
competency
and
proficiency
for
the
grade
level
or
course.

4.
A
teacher
of
record,
in
accordance
with
section
272.7,
14
shall
hold
an
endorsement
for
the
type
of
service
for
which
the
15
teacher
is
employed.

5.
If
the
department
of
education
determines
that
a
school
17
district
is
not
in
compliance
with
this
section,
the
department
18
shall
instruct
the
director
of
the
department
of
management
19
to
withhold
state
aid
to
the
school
district
in
an
amount
20
specified
under
section
256.7,
subsection
31.
The
department
21
of
education
shall
direct
the
department
of
management
to
22
restore
the
amount
withheld
pursuant
to
this
subsection
if
the
23
department
of
education
determines
that
the
school
district
is
24
in
compliance
with
this
section.

EXPLANATION
26
This
bill
directs
the
state
board
of
education
to
define
27
“teacher
of
record”
by
rule,
provides
for
the
number
of
contact
28
hours
a
teacher
of
record
must
have
with
a
given
student
for
29
a
given
subject,
provides
that
a
student
shall
not
advance
to
30
the
next
grade
or
course
level
unless
the
student
meets
the
31
teacher
of
record’s
standards,
and
requires
that
a
teacher
of
32
record
hold
an
endorsement
in
the
subject
for
which
the
teacher
33
is
responsible.
The
bill
provides
for
the
withholding
and
34
restoration
of
state
aid
to
a
school
district
that
violates
the
35

provisions
of
the

student
may

rules
the
bill

requires
the
state
board
to
adopt.
The
department
of
education

shall
direct
the
department
of
management
to
restore
the
amount

withheld
if
the
department
of
education
determines
that
the
