Section
1.
Section
249A.3,
Code
2011,
is
amended
by
adding
1
the
following
new
subsections:

NEW
SUBSECTION
.
15.
In
determining
eligibility
of
an
3
applicant
for
medical
assistance,
the
department
shall
require
4
verification
of
residency
in
the
state.
The
department
5
shall
establish
or
continue
cooperative
arrangements
with
the
6
United
States
social
security
administration,
the
secretary
7
of
state,
the
department
of
revenue,
the
department
of
8
workforce
development,
and
any
other
appropriate
entity
to
9
gain
electronic
access,
to
the
extent
allowed
by
law,
to
10
information
available
to
those
entities
that
may
be
appropriate
11
for
electronically
verifying
an
applicant’s
residency.
The
12
information
provided
shall
be
provided
for
no
other
purpose
13
than
to
verify
residency
and
the
data
requested
shall
be
14
requested
and
provided
only
to
the
extent
necessary
to
15
determine
an
applicant’s
residency.
A
recipient
of
medical
16
assistance
shall
be
subject
to
verification
of
residency
upon
17
renewal
of
eligibility.

NEW
SUBSECTION
.
16.
Unless
required
by
federal
law,
an
19
adult,
with
the
exception
of
a
pregnant
woman,
shall
not
be
20
presumptively
eligible
for
medical
assistance.

Civil
penalty
——
residency

requirement.

In
addition
to
any
other
penalties
applicable,
an
applicant
24
for
medical
assistance
under
this
chapter
who
knowingly
makes
25
or
causes
to
be
made
a
false
statement
or
a
misrepresentation
26
of
a
material
fact
or
knowingly
fails
to
disclose
a
material
27
fact
regarding
the
applicant’s
residency
as
required
pursuant
28
to
section
249A.3,
subsection
15,
is
subject
to
a
civil
penalty
29
of
two
thousand
dollars.

EXPLANATION
31
This
bill
provides
that
in
determining
eligibility
of
an
32
applicant
for
medical
assistance
(Medicaid),
the
department
of
33
human
services
(DHS)
shall
require
verification
of
residency
34
in
the
state.
The
bill
directs
DHS
to
establish
or
continue

any
cooperative
arrangements
with
appropriate
entities
to
gain
1
electronic
access
to
information
available
to
the
entities
that
2
may
be
appropriate
for
electronically
verifying
an
applicant’s

The
bill
also
provides
that
unless
required
4
by
federal
law,
an
adult,
with
the
exception
of
a
pregnant
5
woman,
shall
not
be

Medicaid.
The

bill
also
provides
that,
in
addition
to

penalties

applicable,
an
applicant
for
Medicaid
who
