Section
1.
MEMORANDUM
OF
UNDERSTANDING
——
ENFORCEMENT
OF
1
FEDERAL
IMMIGRATION
LAW.

1.
The
attorney
general
is
authorized
and
directed
to
3
negotiate
the
terms
of
a
memorandum
of
understanding
between
4
the
state
of
Iowa
and
the
United
States
department
of
5
justice
or
the
United
States
department
of
homeland
security
6
concerning
the
enforcement
of
federal
immigration
and
custom
7
laws,
detention
removals,
and
investigations
in
the
state
of
8
Iowa.
The
agreement
shall
designate
a
peace
officer
from
9
a
law
enforcement
agency
in
each
county
to
undergo
United
10
States
immigration
and
customs
enforcement
training.
The
11
agreement
shall
provide
that
costs
incurred
by
the
state
for
12
training
peace
officers
and
the
detention
and
deportation
13
of
an
unauthorized
alien
shall
be
reimbursed
by
the
federal
14
government.

2.
The
memorandum
of
understanding
negotiated
pursuant
to
16
subsection
1
shall
be
signed
on
behalf
of
this
state
by
the
17
attorney
general
and
the
governor
or
as
otherwise
required
by
18
the
appropriate
federal
agency
but
shall
not
be
implemented
19
until
money
is
appropriated
for
such
purpose
by
the
general
20
assembly
and
the
federal
government.

3.
A
local
government
shall
not
enact
any
ordinance,
22
resolution,
or
policy
that
limits
or
prohibits
a
law
23
enforcement
officer,
local
officer,
or
local
government
24
employee
from
communicating
or
cooperating
with
federal
25
officials
with
regard
to
the
immigration
status
of
any
person
26
within
this
state.

4.
Notwithstanding
any
other
provision
of
law,
a
government
28
entity
or
official
within
the
state
of
Iowa
shall
not
prohibit,
29
or
in
any
way
restrict,
any
government
entity
or
official
from
30
sending
to,
or
receiving
from,
the
United
States
department
31
of
homeland
security
information
regarding
the
citizenship
or
32
immigration
status,
lawful
or
unlawful,
of
any
person.

5.
Notwithstanding
any
other
provision
of
law,
a
person
34
or
agency
shall
not
prohibit,
or
in
any
way
restrict,
a

public
employee
from
doing
any
of
the
following
with
respect
1
to
information
regarding
the
immigration
status,
lawful
or

unlawful,
of
any
person:

a.
Sending
such
information
to,
or
requesting
or
receiving
4
such
information
from,
the
United
States
department
of
homeland
5
security.
6
b.
Maintaining
such
information.
7
c.
Exchanging
such
information
with
any
other
federal,
8
state,
or
local
government
entity.

EXPLANATION
10
This
bill
authorizes
the
attorney
general
to
negotiate
11
a
memorandum
of
understanding
on
behalf
of
the
state
with
12
the
United
States
department
of
justice
or
the
United
States
13
department
of
homeland
security
concerning
the
enforcement
of
14
federal
immigration
and
custom
laws,
detention
removals,
and
15
investigations
in
the
state
of
Iowa.
The
bill
also
provides
16
that
the
agreement
shall
designate
a
peace
officer
from
a
law
17
enforcement
agency
in
each
county
to
undergo
United
States
18
immigration
and
customs
enforcement
training.
The
bill
19
requires
that
the
agreement
provide
that
costs
incurred
by
the
20
state
in
training
peace
officers
and
detaining
and
deporting
21
an
unauthorized
alien
must
be
reimbursed
by
the
federal
22
government.
23
The
bill
further
provides
that
a
person,
including
the
state
24
and
any
local
government,
shall
not
restrict
a
public
employee
25
from
communicating
or
cooperating
with
federal
officials
with
26
regard
to
the
immigration
status
of
any
person
within
this
27
state.
