H.F. 257 Section 1. Section 481A.92, subsections 2 and 3, Code 2011, 1 are amended to read as follows: 2 2. a. Except as otherwise provided, a person shall not use 3 chemicals, explosives, smoking devices, mechanical ferrets, 4 wire, tool, instrument, or water to remove fur-bearing animals 5 from their dens. 6 b. Humane traps, conibear type traps, or traps designed to 7 kill instantly, with a jaw spread, as originally manufactured, 8 exceeding eight five inches are unlawful to use except when 9 placed entirely under water. 10 c. It is unlawful to set a conibear type trap in a bucket or 11 similar container with bait or lure. 12 3. Conibear type traps and snares shall not be set on the 13 right-of-way of a public road within two hundred yards of 14 the entry to a private drive serving a residence without the 15 permission of the occupant or within five feet of any fence 16 without the permission of the adjacent landowner or tenant . 17 EXPLANATION 18 This bill prohibits certain trapping practices. The bill 19 prohibits the use of humane traps, conibear type traps, or 20 traps designed to kill instantly with a jaw spread exceeding 21 five inches, unless such traps are placed entirely under water. 22 The bill also prohibits setting a conibear type trap in 23 a bucket or similar container with bait or lure, or setting 24 a conibear type trap or snare within five feet of any fence 25 without the permission of the adjacent landowner or tenant. 26 A violation of the provisions of the bill is punishable with 27 a scheduled fine of $25. 28 -1- LSB 2009HH (3) 84 av/nh 1/ 1
