H.F. 246 Section 1. Section 123.56, subsection 7, Code 2011, is 1 amended to read as follows: 2 7. For the purposes of this section , “manufacturer” includes 3 only those persons the following: 4 a. Persons who process in Iowa the fruit, vegetables, 5 dandelions, clover, honey, or any combination of these 6 ingredients, by fermentation into wines. 7 b. Persons who originate or formulate a design or profile 8 for wine and who contract with another manufacturer for the 9 use of that manufacturer’s facilities for the production of 10 the wine. A manufacturer as defined in this paragraph shall 11 be authorized to sell, deliver, or ship native wine according 12 to the terms of the applicable permit on the same basis 13 as a manufacturer who owns and operates facilities for the 14 production of native wine. 15 EXPLANATION 16 This bill expands the definition of a manufacturer of 17 native wine. A manufacturer of native wine is currently 18 defined in Code section 123.56 to refer only to persons 19 who process specified ingredients by fermentation into 20 wine. The bill provides that a manufacturer also includes 21 persons who originate or formulate a design or profile for 22 wine and contract with another manufacturer for the use of 23 that manufacturer’s facilities for the production of the 24 native wine. The bill states that this new classification of 25 manufacturer shall be authorized to sell, deliver, or ship 26 native wine according to the terms of the applicable permit 27 on the same basis as a manufacturer who owns and operates 28 facilities for the production of native wine. 29 -1- LSB 2290YH (2) 84 rn/nh 1/ 1
