H.F. 2450 Section 1. NEW SECTION . 321.5A Automated traffic law 1 enforcement systems prohibited. 2 1. The department or a local authority shall not place 3 or cause to be placed on or adjacent to a street or highway, 4 or maintain or employ the use of, an automated traffic law 5 enforcement system for the enforcement of any provision of this 6 chapter or any local ordinance relating to vehicular traffic or 7 to prove a violation of any such provision or ordinance. 8 2. For purposes of this section, “automated traffic law 9 enforcement system” means a device with one or more sensors 10 working in conjunction with a traffic control signal or device 11 or a speed-measuring device to produce recorded images of 12 vehicles being operated in violation of traffic or speed laws. 13 “Automated traffic law enforcement system does not include a 14 device operated in the presence of a peace officer or a device 15 mounted on a school bus and operated in the presence of the 16 driver of the school bus. 17 Sec. 2. TERMINATION OF AUTOMATED TRAFFIC LAW ENFORCEMENT 18 PROGRAMS —— REMOVAL OF SYSTEMS —— VALIDITY OF PRIOR NOTICES AND 19 CITATIONS. 20 1. A local authority using an automated traffic law 21 enforcement system shall discontinue using the system on or 22 before the effective date of this Act. A local authority shall 23 remove all automated traffic law enforcement system equipment 24 from the highways on or before July 1, 2012. 25 2. As of the effective date of this Act, all local 26 ordinances authorizing the use of an automated traffic law 27 enforcement system are void. However, notices of violations 28 mailed or citations issued pursuant to such an ordinance 29 prior to the date the ordinance becomes void shall not be 30 invalidated under this Act and shall be processed according to 31 the provisions of the law under which they were authorized. 32 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 33 immediate importance, takes effect upon enactment. 34 EXPLANATION 35 -1- LSB 5038HZ (1) 84 dea/nh 1/ 2
H.F. 2450 This bill prohibits the use of automated traffic law 1 enforcement systems in Iowa. 2 Automated traffic law enforcement systems, commonly known 3 as “red light cameras” or “speed cameras”, are devices with 4 one or more sensors which work in conjunction with a traffic 5 control signal or device or a speed-measuring device to produce 6 recorded images of vehicles being operated in violation of 7 traffic or speed laws. The bill specifies that the term 8 “automated traffic law enforcement system” does not include a 9 device operated in the presence of a peace officer or a device 10 mounted on a school bus and operated in the presence of the 11 school bus driver. 12 The bill requires that a local authority currently using 13 an automated traffic law enforcement system shall discontinue 14 using the system on or before the effective date of the bill. 15 All automated traffic law enforcement system equipment must be 16 removed from the highways by July 1, 2012. 17 A local authority’s ordinance authorizing the use of 18 automated traffic law enforcement systems is void on the 19 effective date of the bill, but notices of violations mailed 20 or citations issued under such an ordinance shall not be 21 invalidated and shall be processed according to the prior law. 22 The bill is effective upon enactment. 23 -2- LSB 5038HZ (1) 84 dea/nh 2/ 2
