H.F. 2396 Section 1. Section 321.1, subsection 4, Code Supplement 1 2011, is amended to read as follows: 2 4. “All-terrain vehicle” means a motor vehicle designed 3 to travel on three or more wheels and designed primarily for 4 off-road recreational use. “All-terrain vehicle” includes 5 off-road utility vehicles as defined in section 321I.1 , but 6 does not include farm tractors or equipment, construction 7 equipment, forestry vehicles, or lawn and grounds maintenance 8 vehicles. 9 Sec. 2. Section 321.1, Code Supplement 2011, is amended by 10 adding the following new subsection: 11 NEW SUBSECTION . 47A. “Off-road utility vehicle” means a 12 motorized flotation-tire vehicle with not less than four and 13 not more than eight low-pressure tires that is limited in 14 engine displacement to less than one thousand five hundred 15 cubic centimeters and in total dry weight to not more than one 16 thousand eight hundred pounds and that has a seat that is of 17 bucket or bench design, not intended to be straddled by the 18 operator, and a steering wheel or control levers for control. 19 Sec. 3. Section 321I.1, subsection 1, paragraph a, Code 20 2011, is amended to read as follows: 21 a. “All-terrain vehicle” means a motorized flotation-tire 22 vehicle with not less than three and not more than six 23 low-pressure nonhighway tires that is limited in engine 24 displacement to less than one thousand cubic centimeters and in 25 total dry weight to less than one thousand two hundred pounds 26 and that has a seat or saddle designed to be straddled by the 27 operator and handlebars for steering control. 28 Sec. 4. Section 321I.1, subsection 16, paragraph a, Code 29 2011, is amended to read as follows: 30 a. “Off-road utility vehicle” means a motorized 31 flotation-tire vehicle with not less than four and not more 32 than eight low-pressure nonhighway tires that is limited in 33 engine displacement to less than one thousand five hundred 34 cubic centimeters and in total dry weight to not more than one 35 -1- LSB 5443HV (2) 84 dea/nh 1/ 2
H.F. 2396 two thousand eight hundred pounds and that has a seat that is 1 of bucket or bench design, not intended to be straddled by the 2 operator, and a steering wheel or control levers for control. 3 EXPLANATION 4 This bill revises the definitions of “all-terrain vehicle” 5 and “off-road utility vehicle” for purposes of Code chapter 6 321I. 7 The definition of “all-terrain vehicle” is amended to 8 include vehicles with not less than three and not more than six 9 nonhighway tires. In addition, the revised definition limits 10 the engine displacement to less than 1,000 cubic centimeters, 11 limits the dry weight to less than 1,200 pounds, and retains 12 current requirements for a seat or saddle designed to be 13 straddled by the operator and handlebars for steering control. 14 The definition of “off-road utility vehicle” is amended to 15 include vehicles with not less than four and not more than 16 eight nonhighway tires. In addition, the revised definition 17 limits the engine displacement to less than 1,500 cubic 18 centimeters, limits the total dry weight to not more than 2,000 19 pounds, and retains current requirements for a bucket or bench 20 seat and a steering wheel or control levers. 21 The bill amends the current definition of “all-terrain 22 vehicle” and adds a definition of “off-road utility vehicle” 23 to Code chapter 321 so that, for purposes of motor vehicle 24 provisions administered by the department of transportation, 25 the definitions of those two terms remain as they are under 26 current law. 27 -2- LSB 5443HV (2) 84 dea/nh 2/ 2
