H.F. 2313 Section 1. Section 321.30, subsection 2, Code 2011, is 1 amended to read as follows: 2 2. a. Unless otherwise provided for in this chapter , the 3 department or the county treasurer shall refuse registration 4 and issuance of a certificate of title unless the vehicle bears 5 a manufacturer’s label pursuant to 49 C.F.R. pt. 567 certifying 6 that the vehicle meets federal motor vehicle safety standards. 7 b. A military vehicle, other than a vehicle that runs on 8 continuous tracks or wheels and tracks, that was originally 9 manufactured for and sold directly to the armed forces of the 10 United States in conformity with contractual specifications, 11 as provided in 49 C.F.R. § 571.7, may be registered and issued 12 a certificate of title if the owner provides satisfactory 13 evidence to the department that the vehicle is substantially 14 in compliance with federal motor vehicle safety standards. 15 The department may adopt rules as necessary concerning the 16 registration and titling of military vehicles in accordance 17 with this chapter. 18 EXPLANATION 19 Under current law, military vehicles which are retired from 20 use by the United States armed forces are not eligible for 21 registration and titling in this state because they do not 22 have a manufacturer’s label certifying that the vehicle meets 23 federal motor vehicle safety standards. Although federal law 24 does not allow the application of the manufacturer’s label on 25 military vehicles, some of those vehicles do meet federal motor 26 vehicle safety standards. This bill allows the department 27 of transportation to register certain military vehicles that 28 were manufactured in conformance with United States military 29 requirements, other than a vehicle that runs on continuous 30 tracks or wheels and tracks, if the owner provides satisfactory 31 evidence that the vehicle is substantially in compliance 32 with federal motor vehicle safety standards.
