H.F. 2235 Section 1. NEW SECTION . 8A.319 Centralized state school 1 bus purchasing program. 2 1. The department shall develop procedures and 3 specifications for the solicitation of bids for the purchase of 4 school buses, in consultation with the department of education, 5 the department of transportation, school districts, and 6 nonpublic schools. In soliciting bids, the department shall 7 conform to all applicable state and federal laws, rules, and 8 regulations regarding standards for school buses. 9 2. As a condition of participating in the state school bus 10 purchasing program, each bidder shall agree that if the bidder 11 subsequently offers a substantially similar bid to another 12 purchaser for a lower price, the bidder’s contract price with 13 the state shall be automatically reduced to match the lower 14 price. 15 3. As a condition of participating in the state school 16 bus purchasing program, each bidder shall agree to include an 17 option for school districts to trade in school buses currently 18 in use. 19 4. The department may award a contract for purchase to 20 any bidder or bidders responsive to the needs of at least 21 one school district or nonpublic school participating in the 22 program. 23 5. Participation in the state school bus purchasing program 24 by school districts and nonpublic schools is voluntary. A 25 school district or nonpublic school may accept any bid for 26 which the department awards a contract for purchase. A school 27 district or nonpublic school participating in the program shall 28 conform to all applicable local, state, and federal laws, 29 rules, and regulations regarding standards for school buses. 30 A school district or nonpublic school may participate in the 31 program in lieu of following the procedures for the purchase of 32 school buses prescribed by chapter 285. 33 6. The department, in conjunction with the department of 34 education and the department of transportation, shall adopt 35 -1- LSB 5513HH (2) 84 je/nh 1/ 3
H.F. 2235 rules to administer this section. 1 Sec. 2. Section 285.10, subsection 7, paragraph b, Code 2 2011, is amended to read as follows: 3 b. By purchasing buses and entering into contracts to pay 4 for such buses in accordance with section 8A.319 or over a 5 five-year period as follows: one-fourth of the cost when the 6 bus is delivered and the balance in equal annual installments, 7 plus simple interest due. The interest rate shall be the 8 lowest rate available and shall not exceed the rate in effect 9 under section 74A.2 . The bus shall serve as security for 10 balance due. Competitive bids on comparable equipment shall be 11 requested on all school bus purchases and shall be based upon 12 minimum construction standards established by the department of 13 education. Bids shall be requested unless the bus is a used or 14 demonstrator bus. 15 EXPLANATION 16 This bill establishes a centralized state school bus 17 purchasing program administered by the department of 18 administrative services. The bill directs the department 19 of administrative services to develop procedures and 20 specifications for the solicitation of bids for the purchase 21 of school buses, in consultation with the department of 22 education, the department of transportation, school districts, 23 and nonpublic schools. In soliciting bids, the department must 24 conform to all applicable state and federal laws, rules, and 25 regulations regarding standards for school buses. 26 The bill provides that as a condition of participating in 27 the state school bus purchasing program, each bidder must agree 28 that if the bidder subsequently offers a substantially similar 29 bid to another purchaser for a lower price, the bidder’s 30 contract price with the state will be automatically reduced to 31 match the lower price.
