H.F. 2205 Section 1. Section 331.461, subsection 2, Code 2011, is 1 amended by adding the following new paragraphs: 2 NEW PARAGRAPH . h. Natural gas facilities, including 3 transmission and distribution systems, and including the 4 acquisition, establishment, construction, purchase, equipment, 5 improvement, extension, operation, maintenance, reconstruction, 6 and repair of such facilities within or outside the borders of 7 the county, and including facilities to be jointly utilized by 8 a county and another political subdivision. 9 NEW PARAGRAPH . i. Electric generating facilities, 10 including generation, transmission, and distribution systems, 11 and including the acquisition, establishment, construction, 12 purchase, equipment, improvement, extension, operation, 13 maintenance, reconstruction, and repair of such facilities 14 located within or outside the borders of the county, and 15 including facilities to be jointly utilized by a county and 16 another political subdivision. 17 EXPLANATION 18 This bill includes natural gas facilities and electric 19 generating facilities within the definition of a county 20 enterprise. 21 The bill provides that a county enterprise shall include 22 natural gas facilities and electric generating facilities, 23 including transmission and distribution systems, and including 24 the acquisition, establishment, construction, purchase, 25 equipment, improvement, extension, operation, maintenance, 26 reconstruction, and repair of such facilities within or outside 27 the borders of the county, and including facilities to be 28 jointly utilized by a county and another political subdivision. 29 With respect to an electric generating facility, the bill also 30 includes generation systems within the definition. 31 Including these facilities within the definition of a county 32 enterprise will enable projects involving such facilities to 33 be financed pursuant to the issuance of revenue bonds by the 34 county. 35 -1- LSB 5767YH (2) 84 rn/sc 1/ 1
