H.F. 2185 Section 1. NEW SECTION . 163.13 Equine animals —— 1 reciprocity with Wisconsin. 2 1. As used in this section, unless the context otherwise 3 requires: “equine animal” means a horse, pony, mule, jenny, 4 donkey, or hinny. 5 2. Notwithstanding section 163.1, an equine animal may be 6 imported from Wisconsin into Iowa under an arrangement with 7 Wisconsin which provides that the owners of equine animals 8 residing in each state are provided reciprocal treatment. 9 Subject to this section, an equine animal may move from 10 Wisconsin into Iowa without a certificate of veterinary 11 inspection issued in this state, without being tested for an 12 infectious or contagious disease afflicting equine animals in 13 this state, and without being subject to a related fee. 14 3. Subsection 2 shall apply to an equine animal imported 15 from Wisconsin only if all of the following restrictions apply: 16 a. The ownership of the equine animal must not change while 17 in this state. 18 b. The equine animal must not remain in this state for more 19 than seven days. 20 c. The equine animal must be accompanied by a document 21 indicating that the equine animal has tested negatively for 22 equine infectious anemia according to requirements that comply 23 with Wisconsin law and rules adopted by the department. 24 d. The equine animal must be in this state for the exclusive 25 purpose of attending an equine trail ride, show, or exhibition. 26 4. The department shall adopt rules as necessary to 27 administer this section. The rules may revise the restrictions 28 provided in subsection 3 or impose additional restrictions or 29 conditions applicable to the importation of an equine animal. 30 To every extent practical, the department shall consult with 31 the Wisconsin department of agriculture, trade, and consumer 32 protection when adopting such rules in order to ensure that the 33 owners of equine animals residing in each state are provided 34 reciprocal treatment. 35 -1- LSB 5424HH (2) 84 da/nh 1/ 3

H.F. 2185 5. The department may suspend the applicability of 1 subsection 2, if the department determines any of the 2 following: 3 a. An outbreak of an infectious or contagious disease 4 afflicting this state’s equine animals requires such 5 suspension. 6 b. Reciprocal treatment is not being accorded to owners 7 of equine animals of Iowa when those animals are moved to 8 Wisconsin. 9 Sec. 2. IMPLEMENTATION. This Act shall be implemented 10 thirty days after the department of agriculture and land 11 stewardship adopts all rules necessary to administer this Act. 12 The department of agriculture and land stewardship shall begin 13 to adopt rules necessary to implement this Act as soon as 14 practicable after the effective date of this Act. 15 EXPLANATION 16 BACKGROUND. The department of agriculture and land 17 stewardship (DALS) is charged to protect animals including 18 livestock from being afflicted from infectious and contagious 19 diseases (Code section 163.1). DALS requires that mature 20 equine animals originating from outside the state be 21 accompanied by an official certificate of veterinary inspection 22 which includes a finding that the animal has tested negative 23 for equine infectious anemia (21 IAC 64.34(6)). Wisconsin 24 law allows an equine animal to enter the state without a 25 certificate of veterinary inspection if (1) the animal 26 remains in the state for seven days or less, (2) the animal 27 is accompanied by a negative infectious anemia test, (3) the 28 animal originates from a state that allows animals to attend 29 trail rides, shows, or exhibitions, and (4) the other state 30 provides similar restrictions as Wisconsin. 31 RECIPROCAL ARRANGEMENT. The bill provides for implementing 32 a reciprocal arrangement between Iowa and Wisconsin. Under the 33 bill, an equine animal may move from Wisconsin to Iowa subject 34 to the same general restrictions that would apply to Iowa 35 -2- LSB 5424HH (2) 84 da/nh 2/ 3

It provides rulemaking 1 authority to DALS, authorizes DALS to adopt more stringent 2 requirements than provided in the bill, and requires DALS to 3 consult with the Wisconsin department of agriculture, trade, 4 and consumer protection when adopting the rules. 5 SUSPENSION. The bill provides that DALS may suspend the 6 reciprocal arrangement if (1) there is an outbreak of an 7 infectious or contagious disease afflicting equine animals or 8 (2) reciprocal treatment is not being accorded to Iowa owners 9 of equine animals. 10 IMPLEMENTATION.
