H.F. 2179 Section 1. Section 368.11, subsection 1, Code 2011, is 1 amended to read as follows: 2 1. A petition for incorporation , discontinuance, or 3 boundary adjustment may be filed with the board by a city 4 council, a county board of supervisors, a regional planning 5 authority, or five percent of the registered voters of a 6 city or territory involved in the proposal. A petition for 7 discontinuance or boundary adjustment may be filed with the 8 board by a city council, a county board of supervisors, a 9 regional planning authority, or five percent of the registered 10 voters of the city involved in the proposal. Notice of the 11 filing, including a copy of the petition, must be served upon 12 the council of each city for which a discontinuance or boundary 13 adjustment is proposed, the board of supervisors for each 14 county which contains a portion of a city to be discontinued or 15 territory to be incorporated, annexed or severed, the council 16 of a city if an incorporation includes territory within the 17 city’s urbanized area, and any regional planning authority for 18 the area involved. 19 EXPLANATION 20 This bill modifies the filing requirements for petitions 21 to the city development board involving involuntary city 22 development action by specifying that a petition for 23 incorporation must be filed with the city development board 24 by 5 percent of registered voters of a territory involved in 25 the proposal, and a petition for discontinuance or boundary 26 adjustment must be filed with the city development board by 27 5 percent of registered voters of the city involved in the 28 proposal. 29 Current law which allows petitions for incorporation, 30 discontinuance, or boundary adjustments to also be filed by 31 a city council, a county board of supervisors, or a regional 32 planning authority involved in the proposal is maintained. 33 -1- LSB 5702YH (2) 84 aw/sc 1/ 1
