Section 218.1, unnumbered paragraph 1, Code 1 2011, is amended to read as follows: 2 The Except as provided in section 904.205, the director 3 of human services shall have the general and full authority 4 given under statute to control, manage, direct, and operate 5 the following institutions under the director’s jurisdiction, 6 and may at the director’s discretion assign the powers and 7 authorities given the director by statute to any one of the 8 deputy directors, division administrators, or officers or 9 employees of the divisions of the department of human services: 10 Sec. 2. Section 226.1, subsection 2, paragraph a, Code 2011, 11 is amended by adding the following new subparagraph: 12 NEW SUBPARAGRAPH . (4) A unit at the mental health institute 13 at Clarinda, designated for nonviolent inmates committed to 14 the custody of the director of the department of corrections 15 who are in need of medical treatment, designated as provided 16 in section 904.205. 17 Sec. 3. Section 904.205, Code 2011, is amended to read as 18 follows: 19 904.205 Clarinda correctional facility. 20 1. The state correctional facility at Clarinda shall be 21 utilized as a secure men’s correctional facility primarily for 22 offenders with chemical dependence, mental retardation, or 23 mental illness , or in need of medical treatment . 24 2. a. A unit of the mental health institute at Clarinda 25 under the control of the department of human services shall 26 be designated, pursuant to a chapter 28E agreement, as a unit 27 of the correctional facility at Clarinda for the purpose of 28 providing medical treatment to nonviolent inmates committed to 29 the custody of the director of the department of corrections. 30 b. As used in this section, “medical treatment” means 31 rehabilitative services for a period exceeding twenty-four 32 consecutive hours for individuals who, because of a mental or 33 physical condition, require nursing care and other services in 34 addition to a patient bed. 35 -1- LSB 5126YH (3) 84 jm/rj 1/ 2
H.F. 2155 EXPLANATION 1 This bill establishes a unit at the mental health institute 2 in Clarinda for the medical treatment of certain inmates 3 committed to the custody of the director of the department of 4 corrections. 5 The bill requires the department of human services, pursuant 6 to a Code chapter 28E agreement, to designate a unit of the 7 Clarinda correctional facility for the purpose of providing 8 medical treatment to nonviolent inmates committed to the 9 custody of the director of the department of corrections. 10 The bill defines “medical treatment” to mean rehabilitative 11 services for a period exceeding 24 consecutive hours for 12 individuals who, because of a mental or physical condition, 13 require nursing care and other services in addition to a 14 patient bed. 15 -2- LSB 5126YH (3) 84 jm/rj 2/ 2
