H.F. 2138 Section 1. Section 232.53, subsection 3, Code 2011, is 1 amended to read as follows: 2 3. a. A dispositional order entered prior to the child 3 attaining the age of seventeen, for a child required to 4 register as a sex offender pursuant to the provisions of 5 chapter 692A , may be extended one year and six months beyond 6 the date the child becomes eighteen years of age. 7 b. A dispositional order entered prior to the child 8 attaining the age of seventeen, for a child ordered to undergo 9 mental health or substance abuse treatment may be extended one 10 year and six months beyond the date the child becomes eighteen 11 years of age or when maximum benefits have been achieved, 12 whichever is earlier. 13 EXPLANATION 14 This bill relates to the duration of dispositional orders in 15 juvenile court due to the commission of a delinquent act. 16 The bill provides that a dispositional order entered prior 17 to a child turning 17 years of age, for a child ordered to 18 undergo mental health or substance abuse treatment may be 19 extended one year and six months beyond the date the child 20 becomes 18 years of age or when maximum benefits have been 21 achieved, whichever is earlier. 22 Under current law, all dispositional orders entered in 23 juvenile court for a child under 17 years of age terminate when 24 the child becomes 18 years of age, except for certain instances 25 when the child is required to register as a sex offender. 26 Current law also allows a dispositional order entered 27 between when a child turns 17 years of age and 18 years of age 28 shall automatically terminate one year and six months after the 29 date of disposition. 30 A dispositional order in juvenile court is similar to a 31 sentencing order in district court. 32 -1- LSB 5699YH (2) 84 jm/rj 1/ 1
