FACILITY
FOR
ELDERLY
SEXUAL
OFFENDERS
COMMITTEE

AND
REPORT.

1.
The
department
of
inspections
and
appeals
shall
3
establish
and
facilitate
a
committee
of
stakeholders
to
examine
4
options
for
designating
a
facility
to
provide
care
for
elderly
5
persons
in
this
state
who
are
no
longer
under
judicial
control,
6
but
have
a
history
of
committing
sexual
offenses
and
have
been
7
determined
to
be
likely
to
reoffend.

2.
The
membership
of
the
committee
shall
include
but
is
not
9
limited
to
the
following:
10
a.
Representatives
of
the
departments
of
inspections
and
11
appeals,
human
services,
public
health,
and
aging,
and
the
12
office
of
the
citizens’
aide.
13
b.
Consumers
of
services
provided
by
health
care
facilities
14
and
family
members
of
consumers.
15
c.
Health
care
facility
administrators
or
owners.
16
d.
Direct
care
workers
employed
by
health
care
facilities.
17
e.
Representatives
from
the
Iowa
legal
aid.
18
f.
Representatives
from
AARP
Iowa.
19
g.
Four
ex
officio,
nonvoting
members,
from
the
general
20
assembly
with
not
more
than
one
member
from
each
chamber
being
21
from
the
same
political
party.
The
two
senators
shall
be
22
appointed,
one
each,
by
the
majority
leader
of
the
senate
and
23
the
minority
leader
of
the
senate.
The
two
representatives
24
shall
be
appointed,
one
each,
by
the
speaker
of
the
house
25
of
representatives
and
the
minority
leader
of
the
house
of
26
representatives.

The
committee
shall
consider
options
to
create
a
new
28
facility
or
assist
an
existing
facility
to
expand
services
29
to
provide
care
for
elderly
persons
who
are
no
longer
under
30
judicial
control,
but
have
a
history
of
committing
sexual
31
offenses
and
have
been
determined
to
be
likely
to
reoffend.

The
committee
shall
identify
the
characteristics
of
a
client
33
for
such
a
facility,
the
need
for
such
a
facility,
options
for
34
creating
a
new
facility
to
house
such
persons,
options
for
35

the
expansion
of
an
existing
facility
to
house
such
persons,

options
for
using
any
alternative
facilities
for
such
purposes,

options
to
qualify
a
facility
for
Medicaid
reimbursement,
cost

projections
for
any
recommendations,
and
other
information
4
deemed
relevant
by
the
department
of
inspections
and
appeals.

The
committee
shall
provide
a
report
detailing
its
6
findings
and
recommendations
to
the
governor
and
the
general
7
assembly
by
December
15,
2012.

EXPLANATION
9
This
bill
establishes
a
committee
to
examine
options
for
10
a
facility
for
elderly
sexual
offenders.
The
bill
directs
11
the
department
of
inspections
and
appeals
to
establish
and
12
facilitate
the
committee.
The
membership
of
the
committee
13
shall
include
but
is
not
limited
to
representatives
from
14
the
departments
of
inspections
and
appeals,
human
services,
15
public
health,
and
aging,
and
the
office
of
the
citizens’
16
aide;
consumers
and
family
members
of
consumers;
health
care
17
facility
administrators,
owners,
and
direct
care
workers;
18
representatives
from
Iowa
legal
aid
and
AARP
Iowa;
and
four
ex
19
officio,
nonvoting
members
from
the
general
assembly.

The
bill
requires
the
committee
to
consider
options
to
21
create
a
new
facility
or
assist
an
existing
facility
to
22
expand
services
to
provide
care
for
elderly
persons
who
23
are
no
longer
under
judicial
control,
but
have
a
history
of
24
committing
sexual
offenses
and
have
been
determined
likely
25
to
reoffend.
The
committee
shall

the
clients
to
be

served
by
the
facility;
the
need
for
such
a
facility;
options

for
creating
a
new
facility,
expanding
an
existing
facility,

or
using
any
alternative
facility
for
the
purpose
of
housing
29
identified
persons;
options
to
qualify
a
facility
for
Medicaid
30
reimbursement;
cost
projections
for
recommendations;
and
other
31
information
deemed
relevant
by
the
department
of
inspections

and
appeals.

The
bill
requires
the
committee
to
provide
a
report
of
its
