H.F. 2118 Section 1. Section 2.40, subsection 1, paragraph a, 1 subparagraph (2), Code 2011, is amended to read as follows: 2 (2) The member shall pay the premium for the plan selected 3 on the same basis as a full-time state employee excluded from 4 collective bargaining as provided in chapter 20 . However, the 5 member shall pay a portion of the total premium for the plan 6 selected in an amount as determined by the legislative council. 7 The payment amount as determined by the legislative council 8 shall be at least one hundred dollars per month. 9 Sec. 2. Section 2.40, Code 2011, is amended by adding the 10 following new subsection: 11 NEW SUBSECTION . 3. A full-time employee of the general 12 assembly who elects to become a member of a state group 13 insurance plan for employees of the state established under 14 chapter 509A shall pay a portion of the total premium for the 15 plan selected in an amount as determined by the legislative 16 council. The payment amount as determined by the legislative 17 council shall be at least one hundred dollars per month. 18 Sec. 3. Section 97B.1A, subsection 26, paragraph a, 19 subparagraph (1), subparagraph division (d), Code Supplement 20 2011, is amended to read as follows: 21 (d) For a member of the general assembly, the total 22 compensation received by a member of the general assembly, 23 whether paid in the form of per diem or annual salary, 24 exclusive of expense expenses, per diem, and travel allowances 25 paid to a member of the general assembly except as otherwise 26 provided in this subparagraph division . Wages includes per 27 diem payments paid to members of the general assembly during 28 interim periods between sessions of the general assembly. 29 Wages also includes daily allowances to members of the general 30 assembly for nontravel expenses of office during a session of 31 the general assembly, but does not include the portion of the 32 daily allowance which exceeds the maximum established by law 33 for members from Polk county. 34 Sec. 4. H.F. 2118 subparagraph (2), subparagraph divisions (h) and (i), Code 1 Supplement 2011, are amended to read as follows: 2 (h) Reimbursements of employee business expenses except for 3 those expenses included as wages for a member of the general 4 assembly . 5 (i) Payments for allowances except for those allowances 6 included as wages for a member of the general assembly . 7 EXPLANATION 8 This bill concerns the health and pension benefits provided 9 for members and full-time employees of the general assembly. 10 Code section 2.40, concerning membership in state insurance 11 plans relative to members and employees of the general 12 assembly, is amended to provide that if members or full-time 13 employees of the general assembly elect coverage in the state 14 group health plan, members and employees shall pay a portion of 15 the total premium for the plan selected in an amount determined 16 by the legislative council. The bill provides that the amount 17 determined by the legislative council shall be at least $100 18 per month. 19 Code section 97B.1A(26), concerning the definition of wages 20 for purposes of the Iowa public employees’ retirement system 21 (IPERS), is amended to provide that per diem payments and daily 22 allowance paid to members of the general assembly are not 23 considered wages for purposes of IPERS. 24 -2- LSB 5091YH (3) 84 ec/sc 2/ 2
