H.F. 197 Section 1. Section 91C.1, subsection 2, Code 2011, is 1 amended by striking the subsection. 2 Sec. 2. Section 91C.3, subsection 1, unnumbered paragraph 3 1, Code 2011, is amended to read as follows: 4 The registration application shall be in the form prescribed 5 by the labor commissioner , shall be accompanied by the 6 registration fee prescribed pursuant to section 91C.4 , and 7 shall contain information which is substantially complete and 8 accurate. In addition to the information determined by the 9 labor commissioner to be necessary for purposes of section 10 91C.2 , the application shall include information as to each of 11 the following: 12 Sec. 3. Section 91C.9, subsection 1, Code 2011, is amended 13 to read as follows: 14 1. A contractor registration revolving fund is created in 15 the state treasury. The revolving fund shall be administered 16 by the commissioner and shall consist of moneys collected 17 by the commissioner as fees. The commissioner shall remit 18 all fees collected pursuant to this chapter to the revolving 19 fund. The moneys in the revolving fund are appropriated to and 20 shall be used by the commissioner to pay the actual costs and 21 expenses necessary to perform the duties of the commissioner 22 and the division of labor as described in this chapter . All 23 salaries and expenses properly chargeable to the revolving fund 24 shall be paid from the revolving fund. 25 Sec. 4. REPEAL. Section 91C.4, Code 2011, is repealed. 26 EXPLANATION 27 This bill repeals Code section 91C.4, which allows the labor 28 commissioner to prescribe a registration fee of up to $50 for 29 construction contractors to register with the department of 30 workforce development.
