H.F. 176 Section 1. NEW SECTION . 7E.8 Implementation of federal law 1 or policy. 2 1. Except as otherwise explicitly established by state law, 3 a state administrative agency charged with the implementation 4 of federal law or policy shall not exceed the specific 5 requirements of that law or policy. 6 2. Any state administrative agency rule or policy that is in 7 violation of subsection 1 is void. 8 EXPLANATION 9 This bill provides that state implementation of federal law 10 or policy by a state administrative agency shall not exceed 11 the specific requirements of the federal law or policy, except 12 as specifically allowed by state law.
