H.F. 170 Section 1. Section 96.4, Code 2011, is amended by adding the 1 following new subsection: 2 NEW SUBSECTION . 8. a. The individual has satisfied a 3 one-week waiting period during the individual’s benefit year. 4 To satisfy the waiting period, the individual, with respect to 5 the week in question: 6 (1) Must be unemployed. 7 (2) Must have filed a claim for benefits in accordance with 8 the provisions of section 96.6, subsection 1. 9 (3) Must be eligible for benefits from this state. However, 10 during the one-week waiting period, the individual must not 11 have received benefits from this state or any other state, and 12 must not be eligible for benefits from any other state. 13 b. If the individual has satisfied the one-week waiting 14 period and the department finds the individual is eligible 15 for benefits for the week subsequent to the one-week waiting 16 period, the individual shall then be paid benefits for the 17 one-week waiting period provided the individual meets all other 18 eligibility requirements of this section. 19 Sec. 2. EFFECTIVE DATE. This Act takes effect July 3, 2011. 20 Sec. 3. APPLICABILITY. This Act applies to unemployment 21 compensation benefit claims with an effective date on or after 22 July 3, 2011. 23 EXPLANATION 24 This bill requires an individual to satisfy a one-week 25 waiting period during the individual’s benefit year in order 26 to receive unemployment compensation benefits. The bill 27 requires that, regarding the week in question, the individual 28 must be unemployed, must have filed a claim for benefits in 29 accordance with Code section 96.6(1), and must be eligible 30 for benefits in the state of Iowa. The bill requires that 31 the individual, regarding the week in question, must not have 32 received unemployment compensation benefits from the state of 33 Iowa or any other state, and must not have been eligible to 34 receive benefits from any other state. H.F. 170 that the individual will be eligible to receive benefits for 1 the one-week waiting period, provided that the department of 2 workforce development finds, for the week immediately following 3 the one-week waiting period, that the individual satisfied all 4 other requirements of Code section 96.4. 5 The bill is effective July 3, 2011, and applies to 6 unemployment compensation benefit claims effective on or after 7 July 3, 2011. 8 -2- LSB 1409YH (1) 84 je/rj 2/ 2
