H.F. 162 Section 1. NEW SECTION . 314.30 T intersection —— 1 modifications to right-of-way. 2 When the department is engaged in the construction, 3 reconstruction, improvement, or repair of a portion of a 4 highway that contains a T intersection and the portion of 5 the right-of-way opposite the junction of the intersecting 6 roadways contains a steep slope or drop-off, the department 7 shall improve the contour of the right-of-way to the extent 8 practicable to mitigate any safety hazard, subject to available 9 funding. 10 EXPLANATION 11 This bill concerns hazardous steep slopes and drop-offs in 12 the right-of-way opposite the junction of intersecting roadways 13 at a T intersection. The bill requires the department of 14 transportation to improve the contour of that portion of the 15 right-of-way containing a steep slope or drop-off to the extent 16 practicable to mitigate any safety hazard, subject to available 17 funding, when the department is engaged in the construction, 18 reconstruction, improvement, or repair of the portion of 19 highway that includes the T intersection. 20 -1- LSB 2008YH (2) 84 dea/nh 1/ 1
