Section
1.
Section
403.5,
subsection
2,
paragraph
b,
Code

2011,
is
amended
to
read
as
follows:

b.
Prior
to
its
approval
of
an
urban
renewal
plan
which
3
provides
for
a
division
of
revenue
pursuant
to
section
403.19
,
4
the
municipality
shall
mail
the
proposed
plan
by
regular
mail
5
to
the
affected
taxing
entities
and
to
the
county
auditor
of
6
each
county
where
the
property
included
within
the
proposed
7
urban
renewal
area
is
located
.
The
municipality
shall
include
8
with
the
proposed
plan
notification
of
a
consultation
to
be
9
held
between
the
municipality
and
affected
taxing
entities
10
prior
to
the
public
hearing
on
the
urban
renewal
plan.
Each
11
affected
taxing
entity
may
appoint
a
representative
to
attend
12
the
consultation.
The
consultation
may
include
a
discussion
of
13
the
estimated
growth
in
valuation
of
taxable
property
included
14
in
the
proposed
urban
renewal
area,
the
fiscal
impact
of
the
15
division
of
revenue
on
the
affected
taxing
entities,
the
16
estimated
impact
on
the
provision
of
services
by
each
of
the
17
affected
taxing
entities
in
the
proposed
urban
renewal
area,
18
and
the
duration
of
any
bond
issuance
included
in
the
plan.

The
designated
representative
of
the
affected
taxing
entity
may
20
make
written
recommendations
for
modification
to
the
proposed
21
division
of
revenue
no
later
than
seven
days
following
the
date
22
of
the
consultation.
The
representative
of
the
municipality
23
shall,
no
later
than
seven
days
prior
to
the
public
hearing
24
on
the
urban
renewal
plan,
submit
a
written
response
to
the
25
affected
taxing
entity
addressing
the
recommendations
for
26
modification
to
the
proposed
division
of
revenue.

Sec.
2.
Section
403.5,
subsection
3,
Code
2011,
is
amended
28
to
read
as
follows:

3.
The
local
governing
body
shall
hold
a
public
hearing
30
on
an
urban
renewal
plan
after
public
notice
thereof
by
31
publication
in
a
newspaper
having
a
general
circulation
in
32
the
area
of
operation
of
the
municipality.
The
notice
shall
33
describe
the
time,
date,
place
and
purpose
of
the
hearing,
34
shall
generally
identify
the
urban
renewal
area
covered
by
the
35

plan,
and
shall
outline
the
general
scope
of
the
urban
renewal
1
activities
under
consideration.
A
copy
of
the
notice
shall
be

sent
by
ordinary
mail
to
each
affected
taxing
entity
and
to

the
county
auditor
of
each
county
where
the
property
included
4
within
the
proposed
urban
renewal
area
is
located
.

Sec.
3.
Section
403.5,
Code
2011,
is
amended
by
adding
the
6
following
new
subsection:

NEW
SUBSECTION
.
4A.
Following
approval
of
an
urban
renewal
8
plan
that
provides
for
a
division
of
revenue
by
ordinance
9
under
section
403.19,
the
ordinance
shall
be
recorded
in
the
10
office
of
the
county
recorder
of
each
county
where
the
property
11
included
within
the
urban
renewal
area
is
located.
The
12
municipality
shall
also,
within
ten
days
of
recording,
file
the
13
urban
renewal
plan
along
with
all
accompanying
plats
of
survey
14
and
other
necessary
documents
in
the
office
of
the
county
15
auditor
of
each
county
where
the
property
included
within
the
16
urban
renewal
area
is
located.

EXPLANATION
18
This
bill
requires
a
municipality
to
provide
notice
of
a
19
proposed
urban
renewal
plan
that
provides
for
a
division
of
20
revenue
to
the
county
auditor
of
each
county
where
the
property
21
included
within
the
proposed
urban
renewal
area
is
located.
22
The
bill
also
requires
the
municipality
to
provide
the
notice
23
of
hearing
on
the
proposed
urban
renewal
plan
to
each
such
24
county
auditor.

The
bill
requires
a
municipality,
following
approval
of
an
26
urban
renewal
plan
that
provides
for
a
division
of
revenue,
27
to
record
the
ordinance
establishing
the
division
of
revenue
28
in
the
office
of
the
county
recorder
of
each
county
where
the
29
property
included
within
the
urban
renewal
area
is
located.
30
The
municipality
is
also
required,
within
10
days
of
recording,
31
to
file
the
urban
renewal
plan
along
with
all
accompanying
32
plats
of
survey
and
other
necessary
documents
in
the
office
of
33
the
county
auditor
of
each
county
where
the
property
included
34
within
the
urban
renewal
area
is
located.
