H.F. 122 Section 1. Section 724.2, Code 2011, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4A. A private investigator or a private 3 security officer who possesses a valid license pursuant to 4 chapter 80A. 5 Sec. 2. Section 724.4, subsection 4, Code 2011, is amended 6 by adding the following new paragraph: 7 NEW PARAGRAPH . l. A private investigator or a private 8 security officer who possesses a valid license pursuant to 9 chapter 80A, while engaged in the performance of official 10 duties. 11 Sec. 3. Section 724.4B, subsection 2, paragraph a, Code 12 2011, is amended to read as follows: 13 a. A person listed under section 724.4, subsection 4 , 14 paragraphs “b” through “f” , or “j” , or “l” . 15 EXPLANATION 16 This bill relates to the authority to possess offensive 17 weapons and the carrying of weapons by a licensed private 18 investigator and a licensed private security officer. 19 The bill allows a private investigator or a private security 20 officer who possesses a valid license pursuant to Code chapter 21 80A to possess offensive weapons, when the person’s duties 22 or lawful activities require or permit such possession. An 23 offensive weapon is defined in Code section 724.1 to include a 24 machine gun, a short-barreled rifle or short-barreled shotgun, 25 certain other weapons which fire or can be made to fire a 26 projectile by the explosion of a propellant charge, a bomb, 27 grenade, or mine, any rocket having a propellant charge of more 28 than four ounces, certain rockets, missiles, and other similar 29 devices, a ballistic knife, any part or combination of parts 30 to be used to convert any device into an offensive weapon, 31 certain bullets, projectiles, shotshells, or cartridges, any 32 mechanical device specifically constructed and designed so that 33 when attached to a firearm silences, muffles, or suppresses the 34 sound when fired, an antique firearm or collector’s firearm, 35 -1- LSB 2083HH (2) 84 rh/rj 1/ 2
H.F. 122 any device which is not designed or redesigned for use as a 1 weapon including signaling, pyrotechnic, line-throwing, or 2 safety devices, and unserviceable firearms. 3 The bill authorizes a private investigator or a private 4 security officer who possesses a valid license pursuant to 5 Code chapter 80A, while engaged in the performance of official 6 duties, to carry a dangerous weapon. Under Code section 702.7, 7 dangerous weapons include but are not limited to any offensive 8 weapon, pistol, revolver, or other firearm, dagger, razor, 9 stiletto, switchblade knife, knife having a blade exceeding 10 five inches in length, or any portable device or weapon 11 directing an electric current, impulse, wave, or beam that 12 produces a high-voltage pulse designed to immobilize a person. 13 The bill authorizes a private investigator or a private 14 security officer who possesses a valid license pursuant to 15 Code chapter 80A, while engaged in the performance of official 16 duties, to carry a firearm on school grounds pursuant to Code 17 section 724.4B. 18 -2- LSB 2083HH (2) 84 rh/rj 2/ 2
