H.F. 10 Section 1. Section 100C.2, subsection 4, paragraph b, Code 1 2011, is amended to read as follows: 2 b. An employee or subcontractor of a certified alarm system 3 contractor who is an alarm system installer , and who is not 4 licensed pursuant to chapter 103 shall obtain and maintain 5 certification as an alarm system installer and shall meet and 6 maintain qualifications established by the state fire marshal 7 by rule. 8 Sec. 2. Section 100C.10, subsection 3, Code 2011, is amended 9 to read as follows: 10 3. The state fire marshal, or the state fire marshal’s 11 designee, and the chairperson of the electrical examining board 12 created in section 103.2 shall be nonvoting ex officio members 13 of the board. 14 Sec. 3. REPEAL. Chapter 103, Code 2011, is repealed. 15 Sec. 4. TRANSITION PROVISIONS. The division of state fire 16 marshal of the department of public safety shall adopt rules 17 establishing a procedure for the refunding of license fees 18 remitted by licensees under chapter 103 on a prorated basis 19 corresponding to the period remaining after December 31, 2011, 20 and prior to a license’s expiration date. 21 Sec. 5. EFFECTIVE DATE The sections of this Act amending 22 sections 100C.2 and 100C.10, and repealing chapter 103, take 23 effect December 31, 2011. 24 EXPLANATION 25 This bill repeals Code chapter 103, providing for statewide 26 licensure of electricians and electrical contractors. The 27 effect of this repeal would be to return to the system of 28 administration and regulation of electricians and electrical 29 contractors, and electrical inspections, by political 30 subdivisions in place prior to the enactment of the Code 31 chapter. The bill directs the division of state fire marshal 32 of the department of public safety to adopt rules providing for 33 refunding license fees on a prorated basis corresponding to 34 the period remaining after the repeal and prior to a license’s 35 -1- LSB 1255YH (4) 84 rn/rj 1/ 2

The bill makes conforming changes within 1 Code chapter 100C, which regulates the licensing of fire 2 extinguishing and alarm system contractors and installers. 3 Provisions of the bill regarding the adoption of rules for 4 prorating license fees take effect July 1, 2011.
