GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 9 1. For the fiscal year beginning July 1, 2010, the goals for 10 the department of economic development shall be to expand and 11 stimulate the state economy, increase the wealth of Iowans, and 12 increase the population of the state. 13 2. To achieve the goals in subsection 1, the department 14 of economic development shall do all of the following for the 15 fiscal year beginning July 1, 2010: 16 a. Concentrate its efforts on programs and activities that 17 result in commercially viable products and services. 18 b. Adopt practices and services consistent with free 19 market, private sector philosophies. 20 c. Ensure economic growth and development throughout the 21 state. 22 Sec. 3. DEPARTMENT OF ECONOMIC DEVELOPMENT. There is 23 appropriated from the general fund of the state to the 24 department of economic development for the fiscal year 25 beginning July 1, 2010, and ending June 30, 2011, the following 26 amounts, or so much thereof as is necessary, to be used for the 27 purposes designated: 28 1. ADMINISTRATION DIVISION 29 a. The administration division shall coordinate with 2 other state agencies to ensure that all state departments are 3 attentive to the needs of an entrepreneurial culture. 4 c. Notwithstanding section 8.33, moneys appropriated in 5 this subsection that remain unencumbered or unobligated at the 6 close of the fiscal year shall not revert but shall remain 7 available for expenditure for the purposes designated until the 8 close of the succeeding fiscal year. 9 2. BUSINESS DEVELOPMENT DIVISION 10 a. For business development operations and programs, the 11 film office, international trade, export assistance, workforce 12 recruitment, and the partner state program; for transfer to the 13 strategic investment fund; for transfer to the grow Iowa values 14 fund; and for the support of the business development division: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,346,530 16 b. The department shall establish a strong and aggressive 17 marketing image to showcase Iowa’s workforce, existing 18 industry, and potential. A priority shall be placed on 19 recruiting new businesses, business expansion, and retaining 20 existing Iowa businesses. Emphasis shall also be placed on 21 entrepreneurial development through helping to secure capital 22 for entrepreneurs, and developing networks and a business 23 climate conducive to entrepreneurs and small business. 24 c. A business creating jobs with economic development 25 assistance through moneys appropriated in this subsection shall 26 be subject to contract provisions stating that new and retained 27 jobs shall be filled by individuals who are citizens of the 28 United States who reside within the United States or any person 29 authorized to work in the United States pursuant to federal 30 law, including legal resident aliens in the United States. Any 31 vendor who receives such public moneys shall adhere to such 32 contract provisions and provide periodic assurances as the 33 state shall require that the jobs are filled solely by citizens 34 of the United States who reside within the United States or 35 -3- LSB 5098XG (8) 83 tm/tm 3/ 15
S.F. _____ H.F. _____ any person authorized to work in the United States pursuant 1 to federal law, including legal resident aliens in the United 2 States. A business that receives financial assistance from 3 the department from moneys appropriated in this bill shall 4 only employ individuals legally authorized to work in this 5 state. In addition to all other applicable penalties provided 6 by current law, all or a portion of the assistance received 7 by a business which is found to knowingly employ individuals 8 not legally authorized to work in this state is subject to 9 recapture by the department. 10 d. From the moneys appropriated in this subsection, the 11 department may provide financial assistance in the form of a 12 grant to a community economic development entity for conducting 13 a local workforce recruitment effort designed to recruit former 14 citizens of the state and former students at colleges and 15 universities in the state to meet the needs of local employers. 16 e. From the moneys appropriated in this subsection, the 17 department may provide financial assistance to early-stage 18 industry companies being established by women entrepreneurs. 19 f. From the moneys appropriated in this subsection, the 20 department may provide financial assistance in the form of 21 grants, loans, or forgivable loans for advanced research and 22 commercialization projects involving value-added agriculture, 23 advanced technology, or biotechnology. 24 g. Notwithstanding section 8.33, moneys appropriated in 25 this subsection that remain unencumbered or unobligated at the 26 close of the fiscal year shall not revert but shall remain 27 available for expenditure for the purposes designated until the 28 close of the succeeding fiscal year. 29 3. COMMUNITY DEVELOPMENT DIVISION 30 a. For support, maintenance, miscellaneous purposes, 31 community economic development programs, tourism operations, 32 community assistance, plans for Iowa green corps and summer 33 youth programs, the mainstreet and rural mainstreet programs, 34 the school-to-career program, the community development block 35 -4- LSB 5098XG (8) 83 tm/tm 4/ 15

The department shall encourage development of 3 communities and quality of life to foster economic growth. The 4 department shall prepare communities for future growth and 5 development through development, expansion, and modernization 6 of infrastructure. 7 c. The department shall develop public-private partnerships 8 with Iowa businesses in the tourism industry, Iowa tour groups, 9 Iowa tourism organizations, and political subdivisions in this 10 state to assist in the development of advertising efforts. 11 The department shall, to the fullest extent possible, develop 12 cooperative efforts for advertising with contributions from 13 other sources. 14 d. Notwithstanding section 8.33, moneys appropriated in 15 this subsection that remain unencumbered or unobligated at the 16 close of the fiscal year shall not revert to any fund but shall 17 remain available for expenditure for the designated purposes 18 during the succeeding fiscal year. 19 4. For allocating moneys for the world food prize and 20 notwithstanding section 15.368, subsection 1: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 750,000 22 5. S.F. _____ H.F. _____ Sec. 4. INSURANCE ECONOMIC DEVELOPMENT. From the moneys 1 collected by the division of insurance in excess of the 2 anticipated gross revenues under section 505.7, subsection 3, 3 during the fiscal year beginning July 1, 2010, $100,000 shall 4 be transferred to the department of economic development for 5 insurance economic development and international insurance 6 economic development. 7 Sec. 5. COMMUNITY DEVELOPMENT LOAN FUND. Notwithstanding 8 section 15E.120, subsection 5, there is appropriated from the 9 Iowa community development loan fund all the moneys available 10 during the fiscal year beginning July 1, 2010, and ending June 11 30, 2011, to the department of economic development for the 12 community development program to be used by the department for 13 the purposes of the program. 14 Sec. 6. WORKFORCE DEVELOPMENT FUND. There is appropriated 15 from the workforce development fund account created in section 16 15.342A to the workforce development fund created in section 17 15.343 for the fiscal year beginning July 1, 2010, and ending 18 June 30, 2011, the following amount, for the purposes of the 19 workforce development fund: 20 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 4,000,000 21 Sec. 7. WORKFORCE DEVELOPMENT ADMINISTRATION. From moneys 22 appropriated or transferred to or receipts credited to the 23 workforce development fund created in section 15.343, up to 24 $400,000 for the fiscal year beginning July 1, 2010, and ending 25 June 30, 2011, are appropriated to the department of economic 26 development for the administration of workforce development 27 activities including salaries, support, maintenance, and 28 miscellaneous purposes. 29 Sec. 8. JOB TRAINING FUND. Notwithstanding section 15.251, 30 all moneys in the job training fund on July 1, 2010, and any 31 moneys appropriated or credited to the fund during the fiscal 32 year beginning July 1, 2010, shall be transferred to the 33 workforce development fund established pursuant to section 34 15.343. 35 -6- LSB 5098XG (8) 83 tm/tm 6/ 15
S.F. _____ H.F. _____ Sec. 9. IOWA STATE UNIVERSITY. 1 1. There is appropriated from the general fund of the state 2 to Iowa state university of science and technology for the 3 fiscal year beginning July 1, 2010, and ending June 30, 2011, 4 the following amount, or so much thereof as is necessary, to 5 be used for small business development centers, the science 6 and technology research park, and the institute for physical 7 research and technology: 8 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,475,983 9 2. Of the moneys appropriated in subsection 1, Iowa state 10 university of science and technology shall allocate at least 11 $878,611 for purposes of funding small business development 12 centers. Iowa state university of science and technology may 13 allocate moneys appropriated in subsection 1 to the various 14 small business development centers in any manner necessary to 15 achieve the purposes of this subsection. 16 3. Iowa state university of science and technology shall do 17 all of the following: 18 a. Direct expenditures for research toward projects that 19 will provide economic stimulus for Iowa. 20 b. Provide emphasis to providing services to Iowa-based 21 companies. 22 4. It is the intent of the general assembly that the 23 industrial incentive program focus on Iowa industrial 24 sectors and seek contributions and in-kind donations from 25 businesses, industrial foundations, and trade associations, 26 and that moneys for the institute for physical research and 27 technology industrial incentive program shall be allocated 28 only for projects which are matched by private sector moneys 29 for directed contract research or for nondirected research. 30 The match required of small businesses as defined in section 31 15.102, subsection 6, for directed contract research or for 32 nondirected research shall be $1 for each $3 of state funds. 33 The match required for other businesses for directed contract 34 research or for nondirected research shall be $1 for each $1 of 35 -7- LSB 5098XG (8) 83 tm/tm 7/ 15

The match required of industrial foundations or 1 trade associations shall be $1 for each $1 of state funds. 2 Iowa state university of science and technology shall 3 report annually to the joint appropriations subcommittee on 4 economic development and the legislative services agency the 5 total amount of private contributions, the proportion of 6 contributions from small businesses and other businesses, and 7 the proportion for directed contract research and nondirected 8 research of benefit to Iowa businesses and industrial sectors. 9 5. Notwithstanding section 8.33, moneys appropriated in 10 this section that remain unencumbered or unobligated at the 11 close of the fiscal year shall not revert but shall remain 12 available for expenditure for the purposes designated until the 13 close of the succeeding fiscal year. 14 Sec. 10. UNIVERSITY OF IOWA. 15 1. There is appropriated from the general fund of the state 16 to the state university of Iowa for the fiscal year beginning 17 July 1, 2010, and ending June 30, 2011, the following amount, 18 or so much thereof as is necessary, to be used for the state 19 university of Iowa research park and for the advanced drug 20 development program at the Oakdale research park, including 21 salaries, support, maintenance, equipment, and miscellaneous 22 purposes: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 222,372 24 2. The state university of Iowa shall do all of the 25 following: 26 a. Direct expenditures for research toward projects that 27 will provide economic stimulus for Iowa. 28 b. There is appropriated from the general fund of the 2 state to the university of northern Iowa for the fiscal year 3 beginning July 1, 2010, and ending June 30, 2011, the following 4 amount, or so much thereof as is necessary, to be used for the 5 metal casting institute, the MyEntreNet internet application, 6 and the institute of decision making, including salaries, 7 support, maintenance, and miscellaneous purposes: 8 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 485,674 9 2. The university of northern Iowa shall do all of the 10 following: 11 a. Direct expenditures for research toward projects that 12 will provide economic stimulus for Iowa. 13 b. Provide emphasis to providing services to Iowa-based 14 companies. 15 3. Notwithstanding section 8.33, moneys appropriated in 16 this section that remain unencumbered or unobligated at the 17 close of the fiscal year shall not revert but shall remain 18 available for expenditure for the purposes designated until the 19 close of the succeeding fiscal year. 20 Sec. 12. DEPARTMENT OF WORKFORCE DEVELOPMENT. There 21 is appropriated from the general fund of the state to the 22 department of workforce development for the fiscal year 23 beginning July 1, 2010, and ending June 30, 2011, the following 24 amounts, or so much thereof as is necessary, for the purposes 25 designated: 26 1. DIVISION OF LABOR SERVICES 27 For the division of labor services, including salaries, 28 support, maintenance, and miscellaneous purposes: 29 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,495,440 30 From the contractor registration fees, the division of labor 31 services shall reimburse the department of inspections and 32 appeals for all costs associated with hearings under chapter 33 91C, relating to contractor registration. 34 2. S.F. _____ H.F. _____ For the division of workers’ compensation, including 1 salaries, support, maintenance, and miscellaneous purposes: 2 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,595,768 3 The division of workers’ compensation shall continue 4 charging a $65 filing fee for workers’ compensation cases. 5 The filing fee shall be paid by the petitioner of a claim. 6 However, the fee can be taxed as a cost and paid by the 7 losing party, except in cases where it would impose an undue 8 hardship or be unjust under the circumstances. The moneys 9 generated by the filing fee allowed under this subsection are 10 appropriated to the department of workforce development to be 11 used for purposes of administering the division of workers’ 12 compensation. 13 3. WORKFORCE DEVELOPMENT OPERATIONS 14 For the operation of field offices, the workforce 15 development board, and new Iowans centers: 16 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 11,645,474 17 Of the moneys appropriated in this subsection, the 18 department shall allocate $11,412,564 for the operation of 19 field offices. The department shall not reduce the number of 20 field offices below the number of field offices being operated 21 as of January 1, 2009. 22 The department of workforce development shall make every 23 effort to maintain new Iowans centers that offer one-stop 24 services to deal with the multiple issues related to 25 immigration and employment. The centers shall be designed to 26 support workers, businesses, and communities with information, 27 referrals, job placement assistance, translation, language 28 training, and resettlement, as well as technical and legal 29 assistance on such issues as forms and documentation. Through 30 the coordination of local, state, and federal service 31 providers, and through the development of partnerships with 32 public, private, and nonprofit entities with established 33 records of international service, these centers shall seek to 34 provide a seamless service delivery system for new Iowans. 35 -10- LSB 5098XG (8) 83 tm/tm 10/ 15

OFFENDER REENTRY PROGRAM 1 For the development and administration of an offender 2 reentry program to provide offenders with employment skills: 3 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 322,261 4 The department shall partner with the department of 5 corrections to provide staff within the correctional facilities 6 to improve offenders’ abilities to find and retain productive 7 employment. 8 5. PILOT PROJECT 9 For purposes of administration of a security employee pilot 10 project training program: 11 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 13,033 12 6. Notwithstanding section 8.33, moneys appropriated in 13 this section that remain unencumbered or unobligated at the 14 close of the fiscal year shall not revert but shall remain 15 available for expenditure for the purposes designated until the 16 close of the succeeding fiscal year. 17 Sec. 13. ACCOUNTABILITY —— AUDIT. The auditor of state 18 shall annually conduct an audit of the department of workforce 19 development and shall report the findings of such annual 20 audit, including the accountability of programs of the 21 department, to the chairpersons and ranking members of the 22 joint appropriations subcommittee on economic development. The 23 department shall pay for the costs associated with the audit. 24 Sec. 14. EMPLOYMENT SECURITY CONTINGENCY FUND. There is 25 appropriated from the special employment security contingency 26 fund to the department of workforce development for the fiscal 27 year beginning July 1, 2010, and ending June 30, 2011, the 28 following amount, or so much thereof as is necessary, for the 29 purposes designated: 30 For the division of workers’ compensation, salaries, 31 support, maintenance, and miscellaneous purposes: 32 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 471,000 33 Any remaining additional penalty and interest revenue is 34 appropriated to and may be allocated and used to accomplish the 35 -11- LSB 5098XG (8) 83 tm/tm 11/ 15

UNEMPLOYMENT COMPENSATION RESERVE FUND. 2 Notwithstanding section 96.9, subsection 8, paragraph “e” , 3 there is appropriated from interest earned on the unemployment 4 compensation reserve fund to the department of workforce 5 development for the fiscal year beginning July 1, 2010, and 6 ending June 30, 2011, the following amount or so much thereof 7 as is necessary, for the purposes designated: 8 For the operation of field offices: 9 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 6,500,000 10 Sec. 16. PUBLIC EMPLOYMENT RELATIONS BOARD. There is 11 appropriated from the general fund of the state to the public 12 employment relations board for the fiscal year beginning July 13 1, 2010, and ending June 30, 2011, the following amount, or so 14 much thereof as is necessary, for the purposes designated: 15 For salaries, support, maintenance, and miscellaneous 16 purposes: 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,051,903 18 Of the moneys appropriated in this section, the board 19 shall allocate $15,000 for maintaining a website that allows 20 searchable access to a database of collective bargaining 21 information. 22 Sec. 17. VALUE ADDED AGRICULTURE FINANCIAL ASSISTANCE. For 23 the fiscal year beginning July 1, 2010, the office of renewable 24 fuels and coproducts may apply to the department of economic 25 development for moneys in the grow Iowa values fund for deposit 26 in the renewable fuels and coproducts fund created in section 27 159A.7. 28 Sec. 18. IOWA FINANCE AUTHORITY AUDIT. The auditor of state 29 is requested to review the audit of the Iowa finance authority 30 performed by the auditor hired by the authority. 31 Sec. 19. APPLICATION FOR DEPARTMENT OF ECONOMIC DEVELOPMENT 32 MONEYS. For the fiscal year beginning July 1, 2010, any 33 entity that was specifically identified in 2001 Iowa Acts, 34 chapter 188, to receive funding from the department of economic 35 -12- LSB 5098XG (8) 83 tm/tm 12/ 15
S.F. _____ H.F. _____ development, excluding any entity identified to receive a 1 direct appropriation beginning July 1, 2010, may apply to the 2 department for assistance through the appropriate program. The 3 department shall provide application criteria necessary to 4 implement this section. 5 Sec. 20. SHELTER ASSISTANCE FUND. In providing moneys from 6 the shelter assistance fund to homeless shelter programs in 7 the fiscal year beginning July 1, 2010, and ending June 30, 8 2011, the department of economic development shall explore the 9 potential of allocating moneys to homeless shelter programs 10 based in part on their ability to move their clients toward 11 self-sufficiency. 12 Sec. 21. UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding 13 section 96.9, subsection 4, paragraph “a” , moneys credited to 14 the state by the secretary of the treasury of the United 15 States pursuant to section 903 of the Social Security 16 Act are appropriated to the department of workforce 17 development and shall be used by the department for the 18 administration of the unemployment compensation program only. 19 This appropriation shall not apply to any fiscal year 20 beginning after December 31, 2009. 21 EXPLANATION 22 This bill makes appropriations and transfers from the 23 general fund of the state and other funds to the department 24 of cultural affairs, the department of economic development, 25 the university of Iowa, the university of northern Iowa, Iowa 26 state university, the department of workforce development, and 27 the public employment relations board for the 2010-2011 fiscal 28 year. 29 The bill provides that the goals for the department of 30 economic development shall be to expand and stimulate the 31 state economy, increase the wealth of Iowans, and increase the 32 population of the state. 33 The bill transfers moneys collected by the division of 34 insurance in excess of the anticipated gross revenues to the 35 -13- LSB 5098XG (8) 83 tm/tm 13/ 15
S.F. _____ H.F. _____ department of economic development for purposes of insurance 1 economic development and international insurance economic 2 development. 3 The bill appropriates moneys from the Iowa community 4 development loan fund to the department of economic development 5 for purposes of the community development program. 6 The bill appropriates moneys from the workforce development 7 fund account to the workforce development fund. 8 The bill provides that moneys appropriated or transferred 9 to or receipts credited to the workforce development fund are 10 appropriated to the department of economic development for 11 administration of workforce development activities. 12 The bill provides that all moneys in the job training fund on 13 July 1, 2010, and any moneys appropriated or credited to the 14 fund during the fiscal year beginning July 1, 2010, shall be 15 transferred to the workforce development fund. 16 The bill requires the auditor of state to conduct an audit of 17 the department of workforce development. 18 The bill appropriates moneys from the special employment 19 security contingency fund to the department of workforce 20 development for the division of workers’ compensation. 21 The bill appropriates interest earned on the unemployment 22 compensation reserve fund to the department of workforce 23 development for the operation of field offices. 24 The bill allows the office of renewable fuels and coproducts 25 to apply to the department of economic development for moneys 26 in the grow Iowa values fund for deposit in the renewable fuels 27 and coproducts fund. 28 The bill requests the auditor of state to review the audit 29 of the Iowa finance authority performed by the auditor hired 30 by the authority. 31 The bill provides that, for the fiscal year beginning July 32 1, 2010, any entity that was specifically identified in 2001 33 Iowa Acts, chapter 188, to receive funding from the department 34 of economic development, excluding any entity identified to 35 -14- LSB 5098XG (8) 83 tm/tm 14/ 15
