S.F. _____ Section 1. Section 15E.193, subsection 1, Code Supplement 1 2009, is amended by adding the following new paragraph: 2 NEW PARAGRAPH . g. Is not located in a five hundred year 3 floodplain. 4 Sec. 2. Section 15E.193B, subsection 2, Code Supplement 5 2009, is amended to read as follows: 6 2. An eligible housing business under this section 7 includes a housing developer, housing contractor, or nonprofit 8 organization that builds or rehabilitates a minimum of four 9 single-family homes located in that part of a city or county 10 in which there is a designated enterprise zone , provided the 11 homes are not located in a five hundred year floodplain or 12 one multiple dwelling unit building containing three or more 13 individual dwelling units located in that part of a city or 14 county in which there is a designated enterprise zone , provided 15 the building is not located in a five hundred year floodplain . 16 Sec. 3. NEW SECTION . 29C.20B Financial assistance 17 limitations —— floodplains. 18 Notwithstanding any provision to the contrary, financial 19 assistance from the state shall not be awarded for any type 20 of development taking place in a five hundred year floodplain 21 unless the intended recipient demonstrates the development is 22 designed to mitigate damage in the event of flooding. 23 EXPLANATION 24 This bill relates to financial assistance for development 25 in 500 year floodplains. 26 The bill provides that a business is not an eligible business 27 under the enterprise zone program if the business is located 28 in a 500 year floodplain. The bill provides that a business 29 is not an eligible housing business under the enterprise zone 30 program if the business builds or rehabilitates homes or 31 multiple dwelling unit buildings in a 500 year floodplain. 32 The bill prohibits financial assistance from the state from 33 being awarded for any type of development taking place in a 34 500 year floodplain unless the intended recipient demonstrates 35 -1- LSB 6181SC (3) 83 tm/sc 1/ 2
