461A.53,
Code
2009,
is
amended
to
read

as
follows:

461A.53
Permits.
3
1.
The
commission
may
enter
into
agreements
for
the
removal
4
of
ice,
sand,
gravel,
stone,
wood,
or
other
natural
material
5
from
lands
or
waters
under
the
jurisdiction
of
the
commission
6
if,
after
investigation,
it
is
determined
that
such
removal
7
will
not
be
detrimental
to
the
state’s
interest.

The
commission
may
specify
the
terms
and
consideration
9
under
which
such
removal
is
permitted
and
issue
written
permits
10
for
such
removal.
However,
the
minimum
annual
royalty
fee
11
for
exclusive
permit
holders
payable
upon
issuance
of
permits
12
for
the
removal
of
sand
and
gravel
from
state-owned
lands
13
and
waters
under
the
jurisdiction
of
the
commission
shall
be
14
one
thousand
dollars
per
year
and
such
permit
holders
shall
15
receive
a
royalty
credit
for
materials
removed
not
exceeding
16
one
thousand
dollars
per
year.

EXPLANATION
18
This
bill
provides
that
the
minimum
annual
royalty
fee
for
19
exclusive
permit
holders
for
removal
of
sand
and
gravel
from
20
state-owned
lands
and
waters
shall
be
$1,000
per
year
and
such
21
permit
holders
shall
receive
royalty
credits
for
materials
22
removed
not
exceeding
$1,000
per
year.
23
Currently,
the
minimum
annual
royalty
fee,
by
rule,
is
24
$10,000
and
the
maximum
royalty
credit
per
year
is
$5,000.
