Definitions.
1
As
used
in
this
chapter,
unless
the
context
otherwise
2
requires:
3
1.
“Chronic
interventional
pain
medicine”
means
the
diagnosis
4
and
treatment
of
pain-related
disorders
primarily
with
the
5
application
of
interventional
techniques
in
managing
subacute,
6
chronic,
persistent,
and
intractable
pain.
7
2.
“Fluoroscope”
means
a
radiologic
instrument
equipped
with
8
a
fluorescent
screen
on
which
opaque
internal
structures
can
9
be
viewed
as
moving
shadow
images
formed
by
the
differential
10
transmission
of
X
rays
throughout
the
body.
11
3.
“Interventional
techniques”
means
percutaneous
needle
12
placement
through
which
drugs
are
then
placed
in
targeted
13
areas,
nerves
are
ablated,
or
certain
surgical
procedures
14
involving
injection
of
steroids,
analgesics,
or
anesthetics
are
15
performed.
“Interventional
techniques”
include
the
following:
16
a.
Lumbar,
thoracic,
and
cervical
spine
injections,
17
intra-articular
injection,
intrathecal
injections,
and
epidural
18
injections,
both
interlaminar
and
transforaminal.

b.
Facet
injections.
20
c.
Discography.
21
d.
Nerve
destruction.
22
e.
Occipital
nerve
blocks.
23
f.
Cervical,
thoracic,
or
lumbar
sympathetic
blocks.
24
g.
Intradiscal
electrothermal
therapy.
25
h.
Spinal
cord
stimulation
or
peripheral
nerve
stimulation.
26
i.
Intrathecal
pump
placement.
27
j.
Ablation
of
targeted
nerves.
28
k.
Vertebroplasty.
29
l.
Kyphoplasty.
30
m.
Utilization
of
fluoroscopy,
computerized
tomography,
31
or
ultrasound
to
assess
the
cause
or
location
of
a
patient’s
32
chronic
pain
or
as
a
means
of
accurately
directing
needles,
33
catheters,
or
electrodes
as
part
of
a
therapeutic
modality
for
34
chronic
pain
treatment.

practices

penalties.

A
person
shall
not
practice
or
offer
to
practice
chronic
3
interventional
pain
medicine
in
this
state
unless
such
person
4
has
been
duly
licensed
under
the
provisions
of
chapter
148
to
5
engage
in
the
practice
of
medicine
and
surgery
or
osteopathic
6
medicine
and
surgery,
chapter
149
to
engage
in
the
practice
7
of
podiatry,
or
chapter
153
to
engage
in
the
practice
of
8
dentistry.
Any
person
who
violates
this
section
commits
9
a
serious
misdemeanor,
as
provided
in
section
147.86,
and
10
is
subject
to
the
injunction,
punishment,
and
enforcement
11
provisions
set
forth
in
chapter
147.
12
EXPLANATION
13
This
bill
specifically
defines
the
practice
of
chronic
14
interventional
pain
medicine
and
the
techniques
used
in
that
15
practice.
The
bill
limits
the
practice
of
interventional
pain
16
medicine
to
licensed
physicians,
podiatrists,
or
dentists.
17
A
violation
of
the
bill
is
a
serious
misdemeanor.
A
serious
18
misdemeanor
is
punishable
by
a
fine
of
at
least
$315
but
not
to
19
exceed
$1,875
and
imprisonment
not
to
exceed
one
year.
