Section 103.1, Code Supplement 2009, is amended 1 by adding the following new subsection: 2 NEW SUBSECTION . 12A. “Residential electrical contractor” 3 means a person affiliated with an electrical contracting firm 4 or business who is, or who employs a person who is, licensed by 5 the board as a residential master electrician and who is also 6 registered with the state of Iowa as a contractor pursuant to 7 chapter 91C. 8 Sec. 2. Section 103.1, subsection 13, Code Supplement 2009, 9 is amended to read as follows: 10 13. “Residential electrician” means a person having the 11 necessary qualifications, training, experience, and technical 12 knowledge to perform a residential installation and to 13 supervise apprentice electricians . 14 Sec. 3. Section 103.1, subsection 15, Code Supplement 2009, 15 is amended to read as follows: 16 15. “Residential master electrician” means a person having 17 the necessary qualifications, training, experience, and 18 technical knowledge to properly plan, lay out, and supervise 19 the performance of a residential installation and who is 20 licensed by the board . 21 Sec. 4. Section 103.6, subsection 1, paragraph b, 22 subparagraph (2), Code 2009, is amended to read as follows: 23 (2) Is an electrical contractor or a residential electrical 24 contractor and fails or refuses to provide and keep in force a 25 public liability insurance policy and surety bond as required 26 by the board. 27 Sec. 5. Section 103.8, Code 2009, is amended to read as 28 follows: 29 103.8 Activities where license required —— exceptions. 30 1. No person, except a person licensed as an electrical 31 contractor or a residential electrical contractor , shall engage 32 in the business of providing new electrical installations or 33 any other electrical services regulated under this chapter. 34 2. S.F. _____ H.F. _____ no person shall, for another, plan, lay out, or supervise 1 the installation of wiring, apparatus, or equipment for 2 electrical light, heat, power, and other purposes unless the 3 person is licensed by the board as an electrical contractor, 4 a residential electrical contractor, a class A master 5 electrician, or a class B master electrician , or a residential 6 master electrician . 7 Sec. 6. Section 103.11, Code 2009, is amended to read as 8 follows: 9 103.11 Wiring or installing —— supervising apprentices —— 10 license required —— qualifications. 11 Except as provided in section 103.13, no a person shall 12 not , for another, wire for or install electrical wiring, 13 apparatus, or equipment, or supervise an apprentice electrician 14 or unclassified person, unless the person is licensed by the 15 board as an electrical contractor or residential electrical 16 contractor , a class A master electrician , or a class B master 17 electrician, or is licensed as a class A journeyman electrician 18 or a class B journeyman electrician , or a residential master 19 electrician or a residential electrician, and is employed 20 by an electrical contractor or a residential electrical 21 contractor, or is working under the supervision of a class 22 A master electrician , or a class B master electrician , or a 23 residential master electrician . 24 Sec. 7. Section 103.12A, Code Supplement 2009, is amended 25 to read as follows: 26 103.12A Residential electrician and residential master 27 electrician license installations —— licenses —— qualifications. 28 1. The board may by rule provide for the issuance of a 29 residential electrician license, and may by rule provide for 30 the issuance of a residential master electrician license , and a 31 residential electrical contractor license . 32 a. A residential electrician license or residential 33 master electrician license provided for in subsection 1 , if 34 established by the board, shall be issued to applicants who 35 -2- LSB 5423DP (4) 83 rn/rj 2/ 6
S.F. _____ H.F. _____ meet qualifications determined by the board, and shall be valid 1 for the performance of residential installations, subject to 2 limitations or restrictions established by the board. 3 b. A person who, on or after July 1, 2009, holds a special 4 electrician license authorizing residential electrical 5 installation, granted pursuant to section 103.13, shall be 6 eligible for conversion of that special license to either 7 a residential electrician license or a residential master 8 electrician license, if established by the board, in accordance 9 with requirements and procedures established by the board. 10 2. A person licensed by the board as a class A journeyman 11 electrician or a class B journeyman electrician, or as a class 12 A master electrician or a class B master electrician, shall not 13 be required to hold a residential electrician or residential 14 master electrician license to perform any type of residential 15 installation authorized for a person licensed pursuant to this 16 section. 17 3. A person licensed by the board as an electrical 18 contractor shall not be required to hold a residential 19 electrical contractor license to perform any type of 20 residential installation authorized for a person licensed 21 pursuant to this section. 22 3. 4. The board may reject an application for licensure 23 under this section from an applicant who would be subject 24 to suspension, revocation, or reprimand pursuant to section 25 103.35. 26 Sec. 8. Section 103.13, subsection 2, Code Supplement 2009, 27 is amended to read as follows: 28 2. Notwithstanding section 103.8, a person who holds a 29 special electrician license is not required to obtain an 30 electrical contractor license or a residential electrical 31 contractor license to engage in the business of providing new 32 electrical installations or any other electrical services if 33 such installations or services fall within the limited class of 34 special electrical work for which the person holds the special 35 -3- LSB 5423DP (4) 83 rn/rj 3/ 6
S.F. _____ H.F. _____ electrician license. 1 Sec. 9. Section 103.15, subsection 1, Code Supplement 2009, 2 is amended to read as follows: 3 1. A person shall be licensed by the board and pay a 4 licensing fee to work as an apprentice electrician while 5 participating in an apprenticeship training program registered 6 by the bureau of apprenticeship and training of the United 7 States department of labor in accordance with the standards 8 established by that department. An apprenticeship shall 9 be limited to six years from the date of licensure, unless 10 extended by the board upon a finding that a hardship existed 11 which prevented completion of the apprenticeship program. Such 12 licensure shall entitle the licensee to act as an apprentice 13 to an electrical contractor, a class A master electrician, a 14 class B master electrician, a class A journeyman electrician, 15 or a class B journeyman electrician , a residential electrical 16 contractor, a residential master electrician, or a residential 17 electrician as provided in subsection 3. 18 Sec. 10. Section 103.19, subsection 1, paragraph a, 19 subparagraph (1), Code Supplement 2009, is amended to read as 20 follows: 21 (1) Electrical contractor or residential electrical 22 contractor , one hundred twenty-five dollars. 23 Sec. 11. Section 103.20, subsection 2, Code 2009, is amended 24 to read as follows: 25 2. Upon the death of an electrical contractor, a class 26 A master electrician, or a class B master electrician, a 27 residential electrical contractor, or a residential master 28 electrician, the board may permit a representative to carry on 29 the business of the decedent for a period not to exceed six 30 months for the purpose of completing work under contract to 31 comply with this chapter. Such representative shall furnish 32 all public liability and property damage insurance required by 33 the board. 34 Sec. 12. Section 103.33, subsection 3, Code Supplement 1 -4- LSB 5423DP (4) 83 rn/rj 4/ 6

Upon receipt of notice of appeal from a condemnation 3 or disconnection order because the electrical installation is 4 not in compliance with accepted standards of construction for 5 safety to health and property, except as provided in subsection 6 2, the order appealed from shall be stayed until final decision 7 of the board and the board shall notify the property owner and 8 the electrical contractor, class A master electrician, class B 9 master electrician, fire alarm installer, special electrician, 10 or if established by the board the residential electrical 11 contractor, or residential master electrician, making the 12 installation. The power supplier shall also be notified in 13 those instances in which the order has been served on such 14 supplier. 15 Sec. 13. Section 103.39, subsection 1, paragraph b, Code 16 2009, is amended to read as follows: 17 b. Uses or employs the words “electrical contractor” , 18 “class A master electrician” , “class B master electrician” , 19 “class A journeyman electrician” , or “class B journeyman 20 electrician ”, “residential electrical contractor” , “residential 21 master electrician” , or “residential electrician”, or implies 22 authorization to provide or offer those services, or otherwise 23 uses or advertises any title, word, figure, sign, card, 24 advertisement, or other symbol or description tending to convey 25 the impression that the person is an “electrical contractor” , 26 “class A master electrician” , “class B master electrician” , 27 “class A journeyman electrician” , or “class B journeyman 28 electrician” , “residential electrical contractor” , “residential 29 master electrician” , or “residential electrician” . 30 EXPLANATION 31 This bill adds a new licensure classification and modifies 32 requirements applicable to existing classifications with regard 33 to residential electrical installations authorized in Code 34 chapter 103. 35 The bill establishes the new licensure classification of 1 -5- LSB 5423DP (4) 83 rn/rj 5/ 6
S.F. _____ H.F. _____ residential electrical contractor, defined to mean a person 2 affiliated with an electrical contracting firm or business who 3 is, or who employs a person who is, licensed by the board as 4 a residential master electrician and who is also registered 5 with the state of Iowa as a contractor pursuant to Code 6 chapter 91C. The bill modifies the definition of a residential 7 electrician to authorize the supervision of apprentice 8 electricians; and clarifies with respect to the definitions of 9 both this definition and the definition of a residential master 10 electrician that such persons are licensed by the board, in 11 order to be consistent with the other licensure classification 12 definitions established in the Code chapter. 13 The bill makes changes to existing residential installation 14 provisions and other provisions in the Code chapter 15 consistent with the new licensure classification, and 16 adds each residential licensure classification to the 17 list of classifications authorized to supervise apprentice 18 electricians. 19 The bill prescribes a fee for the issuance and renewal of 20 a residential electrical contractor license. The bill also 21 applies the residential electrical installation licensure 22 classifications, as appropriate, to provisions regarding 23 continuation of business upon death, notification of appeal 24 from a condemnation or disconnection order, and applicable 25 civil penalties. 26 -6- LSB 5423DP (4) 83 rn/rj 6/ 6
