Section 232.150, subsection 1, paragraph a, 1 unnumbered paragraph 1, Code 2009, is amended to read as 2 follows: 3 Upon application of The court, on its own motion, shall 4 order the scheduling of a hearing two years from the date of 5 the last official action in a case where a person who was 6 taken into custody for a delinquent act or was the subject 7 of a complaint alleging delinquency or was the subject of a 8 delinquency petition, or upon the court’s own motion, the 9 court, after hearing, shall order or two years after the child 10 becomes eighteen years of age, whichever is later, and order, 11 if there is no objection from the county attorney, the official 12 juvenile court records in the case including those specified 13 in sections 232.147 and 232.149 sealed if the court finds all 14 of the following: 15 Sec. 2. Section 232.150, subsection 1, paragraph a, 16 subparagraph (1), Code 2009, is amended by striking the 17 subparagraph. 18 EXPLANATION 19 This bill relates to the sealing of juvenile delinquency 20 records. 21 The bill provides that the court, on its own motion, shall 22 order the scheduling of a hearing two years from the date of 23 the last official action in a juvenile delinquency case, or 24 after the child becomes 18 years of age, whichever is later, 25 and order, if there is no objection from the county attorney, 26 the delinquency records be sealed. 27 In order for juvenile records to be sealed, current 28 provisions and the bill require that the juvenile has not 29 committed any subsequent criminal violations greater than a 30 simple misdemeanor and that the juvenile has successfully 31 completed any youthful offender placement. 32 -1- LSB 5565XC (3) 83 jm/rj 1/ 1
