  1  1    Section 1.  NEW SECTION.  103A.20A  BUILDING PERMITS IN
  1  2 DISASTER=AFFECTED AREAS.
  1  3    A local building department shall not deny approval or
  1  4 issuance of a plan, permit, license, certificate, or similar
  1  5 document prescribed or required by state or local building
  1  6 regulations on the ground that the property is located in an
  1  7 area that may in the future be the subject of a property
  1  8 acquisition proposal by a governmental subdivision.  A plan,
  1  9 permit, license, certificate, or similar document may be
  1 10 disapproved, denied, or revoked by a local building department
  1 11 if the owner of the property has accepted an offer to sell the
  1 12 property to a governmental subdivision pursuant to a property
  1 13 acquisition proposal.  For the purposes of this section,
  1 14 "property acquisition proposal" means a financial incentive or
  1 15 compensation offered by a governmental subdivision to a
  1 16 property owner in exchange for the title to property located
  1 17 within an area that was damaged by a disaster as defined in
  1 18 section 29C.2.
  1 19                           EXPLANATION
  1 20    This bill prohibits a local building department from
  1 21 denying approval or issuance of a plan, permit, license,
  1 22 certificate, or similar document prescribed or required by
  1 23 state or local building regulations on the ground that the
  1 24 property is located in an area that may in the future be the
  1 25 subject of a property acquisition proposal by a governmental
  1 26 subdivision.  The bill provides that a plan, permit, license,
  1 27 certificate, or similar document may be denied, disapproved,
  1 28 or revoked by a local building department if the owner of the
  1 29 property has accepted an offer to sell the property to a
  1 30 governmental subdivision pursuant to a property acquisition
  1 31 proposal, as defined in the bill.
