Senate Resolution 115 - Introduced SENATE RESOLUTION NO. 115 BY COURTNEY A Resolution requesting the legislative council to act 1 in support of the Iowa board of pharmacy contracting 2 to convene a task force on medical marijuana. 3 WHEREAS, the board of pharmacy performed a careful 4 evaluation and held hearings around the state in 2009 5 prior to developing a recommendation regarding the 6 usage of marijuana for medicinal purposes; and 7 WHEREAS, in February 2010 the board of pharmacy 8 unanimously recommended reclassifying the drug to 9 allow its use for pain, nausea, and other symptoms from 10 diseases such as cancer, acquired immune deficiency 11 syndrome (AIDS), and multiple sclerosis; and 12 WHEREAS, the board of pharmacy recommended formation 13 of a task force to make recommendations regarding the 14 administration of a medical marijuana program; NOW 15 THEREFORE, 16 BE IT RESOLVED BY THE SENATE, That the legislative 17 council is requested to act in support of the board 18 of pharmacy contracting to convene a task force on 19 medical marijuana to meet during the 2010 legislative 20 interim; and 21 BE IT FURTHER RESOLVED, That the task force be 22 charged to study and make recommendations regarding 23 reclassifying marijuana from schedule I of Iowa’s 24 controlled substances law under Code chapter 124 into 25 schedule II of the law, and for implementation and 26 administration of a medical marijuana program; and 27 BE IT FURTHER RESOLVED, That the voting membership 28 -1- LSB 6282XS (3) 83 jp/nh 1/ 2
S.R. 115 of the task force should include but not be limited to 1 all of the following: 2 1. A representative of a seriously ill patient. 3 2. A representative of law enforcement. 4 3. A representative of the attorney general. 5 4. A representative of a human immunodeficiency 6 virus (HIV) organization or a physician caring for a 7 patient with AIDS. 8 5. A representative of substance abuse treatment 9 providers. 10 6. A person who is living with a serious illness 11 or a representative of a hospice or palliative care 12 provider. 13 7. A representative of the Iowa board of nursing. 14 8. A representative of the Iowa board of medicine. 15 9. Two representatives of the Iowa board of 16 pharmacy. 17 10. A physician who is caring for a patient with 18 cancer. 19 BE IT FURTHER RESOLVED, That, in addition to the 20 voting membership, four legislative members from 21 both political parties and both houses of the general 22 assembly should be appointed to act as ex officio, 23 nonvoting members of the task force; and 24 BE IT FURTHER RESOLVED, That the task force be 25 directed to submit a report, including findings and 26 recommendations, to the governor, general assembly, and 27 board of pharmacy on or before December 15, 2010. 28 -2- LSB 6282XS (3) 83 jp/nh 2/ 2
