  1  1    Section 1.  Section 481A.21, Code 2009, is amended to read
  1  2 as follows:
  1  3    481A.21  BIRDS AS TARGETS.
  1  4    A person shall not keep or use any live pigeon or other
  1  5 bird as a target, to be shot at for amusement or as a test of
  1  6 skill in marksmanship, or shoot at a bird kept or used for
  1  7 such purpose, or be a party to such shooting, or lease any
  1  8 building, room, field, or premises, or knowingly permit the
  1  9 use thereof, for the purpose of such shooting.  This section
  1 10 does not prevent any person from shooting at live pigeons,
  1 11 sparrows, and starlings when used in the training of hunting
  1 12 dogs.  This section does not prevent any person from shooting
  1 13 at a bird that is released a minimum of fifty yards from that
  1 14 person on a licensed hunting preserve.
  1 15    Sec. 2.  Section 483A.1, subsection 1, paragraphs b and d,
  1 16 Code 2009, are amended to read as follows:

  3  2    Sec. 4.  Section 483A.8, subsection 6, Code 2009, is
  3  3 amended to read as follows:
  3  4    6.  The commission shall provide by rule for the annual
  3  5 issuance to a nonresident of a nonresident antlerless deer
  3  6 hunting license that is valid for use only during the period
  3  7 beginning on December 24 and ending at sunset on January 2 of
  3  8 the following year, and costs fifty seventy=five dollars.  A
  3  9 nonresident hunting deer with a license issued under this
  3 10 subsection shall be otherwise qualified to hunt deer in this
  3 11 state and shall have a nonresident hunting license, pay the
  3 12 wildlife habitat fee, and pay the one dollar fee for the
  3 13 purpose of deer herd population management as provided in
  3 14 subsection 3.  Pursuant to this subsection, the commission
  3 15 shall make available for issuance only the remaining
  3 16 nonresident antlerless deer hunting licenses allocated under
  3 17 subsection 3 that have not yet been issued for the current
  3 18 year's nonresident antlerless deer hunting seasons.
  3 19    Sec. 5.  EFFECTIVE DATE.  This Act, being deemed of
  3 20 immediate importance, takes effect upon enactment.
  3 21                           EXPLANATION
  3 22    This bill regulates various hunting, fishing, and trapping
  3 23 activities under the jurisdiction of the department of natural
  3 24 resources, modifies fees, and makes penalties applicable.
  3 25    WILDLIFE CONSERVATION.  Code section 481A.21 is amended to
  3 26 provide that the prohibition against keeping or using birds as
  3 27 targets does not apply to a person who shoots at a bird that
  3 28 is released at least 50 yards from that person on a licensed
  3 29 hunting preserve.
  3 30    FISHING AND HUNTING LICENSES.  Code section 483A.1 is
  3 31 amended to increase fees for certain nonresident hunting and
  3 32 fishing licenses.
  3 33    Code section 483A.1 is also amended to provide that
  3 34 lifetime fishing licenses and hunting licenses are only
  3 35 available to residents who are 67 years of age or older
  4  1 instead of 65 years of age or older.
  4  2    Code section 483A.8 is amended to increase the fee for the
  4  3 special nonresident holiday antlerless deer hunting license
  4  4 from $50 to $75.
  4  5    The bill takes effect upon enactment.
