Section
1.
Section
461A.53,
Code
2009,
is
amended
to
read
1
as
follows:

461A.53
Permits.
3
1.
The
commission
may
enter
into
agreements
for
the
removal
4
of
ice,
sand,
gravel,
stone,
wood,
or
other
natural
material
5
from
lands
or
waters
under
the
jurisdiction
of
the
commission
6
if,
after
investigation,
it
is
determined
that
such
removal
7
will
not
be
detrimental
to
the
state’s
interest.

2.
The
commission
may
specify
the
terms
and
consideration
9
under
which
such
removal
is
permitted
and
issue
written
permits
10
for
such
removal.

3.
Notwithstanding
subsection
2,
the
commission
shall
issue
12
written
permits
with
a
royalty
fee
of
ten
cents
per
ton
for
the
13
removal
of
sand
and
gravel
for
the
purposes
of
flood
control
14
from
state-owned
lands
and
waters
under
the
jurisdiction
of
15
the
commission
located
on
the
Cedar
river
in
a
county
with
a
16
population
of
more
than
two
hundred
thousand.
This
subsection
17
is
repealed
on
June
30,
2015.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
19
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
21
This
bill
requires
the
natural
resource
commission
to
issue
22
written
permits
with
a
royalty
fee
of
10
cents
per
ton
for
the
23
removal
of
sand
and
gravel
for
the
purposes
of
flood
control
24
from
state-owned
lands
and
waters
under
the
commission’s
25
jurisdiction
located
on
the
Cedar
river
in
a
county
with
a
26
population
of
more
than
200,000.
This
provision
is
repealed
27
on
June
30,
2015.
The
royalty
fee
for
dredging
in
other
areas
28
remains
at
25
cents
per
ton.
