S.F. 2341 Section 1. Section 411.13, Code 2009, is amended to read as 1 follows: 2 411.13 Exemption from execution and other process or 3 assignment —— exceptions. 4 The right of any person to a pension, annuity, or retirement 5 allowance, to the return of contributions, the pension, 6 annuity, or retirement allowance itself, any optional benefit 7 or death benefit, any other right accrued or accruing to 8 any person under this chapter, and the moneys in the fire 9 and police retirement fund created under this chapter, are 10 not subject to execution, garnishment, attachment, or any 11 other process whatsoever, and are unassignable except for 12 the purposes of enforcing child, spousal, or medical support 13 obligations or marital property orders, or as otherwise 14 specifically provided in this chapter. For the purposes of 15 enforcing child, spousal, or medical support obligations, 16 the garnishment or attachment of or the execution against 17 compensation due a person under this chapter shall not exceed 18 the amount specified in 15 U.S.C. § 1673(b). The retirement 19 system shall comply with the provisions of a marital property 20 order requiring a particular benefit distribution or designated 21 beneficiary if the selection is not otherwise prohibited by 22 this chapter. 23 EXPLANATION 24 This bill provides the statewide fire and police retirement 25 system created in Code chapter 411 shall comply with the 26 provisions of a marital property order requiring a particular 27 benefit distribution or designated beneficiary if the selection 28 is not otherwise prohibited by Code chapter 411. 29 -1- LSB 5809XS (2) 83 ec/nh 1/ 1
