S.F. 2332 Section 1. MEDICAL ASSISTANCE WAIVER SERVICES FOR 1 PERSONS WITH INTELLECTUAL DISABILITIES —— REIMBURSEMENT OF 2 ADMINISTRATIVE COSTS. 3 1. The department of human services shall adopt rules to 4 provide that administrative costs shall not exceed eighteen 5 percent of program costs for services under the medical 6 assistance home and community-based services waiver for 7 intellectual disabilities. The rules shall provide that 8 administrative costs for such waiver are comprised of those 9 costs incurred in the general management and administrative 10 functions of the program, as defined by administrative rules 11 adopted for intermediate care facilities for individuals with 12 mental retardation, and shall be based on generally accepted 13 accounting principles. 14 2. The department may adopt emergency rules under section 15 17A.4, subsection 3, and section 17A.5, subsection 2, paragraph 16 “b” , to implement the provisions of this section and the rules 17 shall be effective immediately upon filing unless a later date 18 is specified in the rules. Any rules adopted in accordance 19 with this section shall also be published as a notice of 20 intended action as provided in section 17A.4. 21 EXPLANATION 22 This bill directs the department of human services to 23 adopt rules to provide that administrative costs shall not 24 exceed 18 percent of program costs for services under the 25 medical assistance home and community-based services waiver 26 for intellectual disabilities. Administrative costs are 27 costs incurred in the general management and administrative 28 functions of the program, as defined by administrative rules 29 adopted for intermediate care facilities for individuals with 30 mental retardation and are to be based on generally accepted 31 accounting principles. The bill also authorizes the department 32 to adopt emergency rules to implement the bill.
