S.F. 2323 Section 1. Section 99F.7, subsection 2, paragraph c, Code 1 2009, is amended to read as follows: 2 c. A person awarded a new license to conduct gambling games 3 on an excursion gambling boat or gambling structure in the same 4 county as another licensed excursion gambling boat or gambling 5 structure shall only be licensed to operate an excursion 6 gambling boat or gambling structure that is located at a 7 similarly situated site and operated as a substantially similar 8 facility as any other excursion gambling boat or gambling 9 structure in the county. This paragraph “c” shall only apply to 10 counties with a population of one hundred thousand or less. 11 EXPLANATION 12 This bill provides that the requirement that a person 13 may only be awarded a new license to conduct gambling games 14 on an excursion gambling boat or gambling structure in the 15 same county as another licensed gambling boat or structure 16 if the new licensee is located at a similarly situated site 17 and operated as a substantially similar facility as any other 18 existing licensed gambling boat or structure in the county 19 applies only to counties with a population of 100,000 or less. 20 -1- LSB 5071SV (2) 83 ec/nh 1/ 1
