S.F. 2307 Section 1. Section 613.15, Code 2009, is amended by striking 1 the section and inserting in lieu thereof the following: 2 613.15 Injury to or death of spouse or parent. 3 1. A spouse or child of a person may recover for the expense 4 and actual loss of support, services, companionship, and 5 society resulting from injury to or death of the person. 6 2. In the case of an injury to or death of a person 7 under subsection 1, the calculation of damages recoverable 8 shall include but not be limited to the present value of the 9 fair market value of replacement services for child care, 10 housekeeping, cleaning, transportation, food preparation, 11 shopping, laundry, and any other services lost. 12 EXPLANATION 13 This bill relates to civil damages recoverable for injury to 14 or death of a person. 15 The bill provides that a spouse or child of a person may 16 recover for the expense and actual loss of support, services, 17 companionship, and society resulting from injury to or death 18 of the person. 19 The bill provides that, in the case of an injury to or 20 death of a person under the bill, the calculation of damages 21 recoverable shall include but not be limited to the present 22 value of the fair market value of replacement services for 23 child care, housekeeping, cleaning, transportation, food 24 preparation, shopping, laundry, and any other services lost. 25 -1- LSB 5780SV (2) 83 rh/rj 1/ 1
