S.F. 2290 Section 1. Section 298.3, Code Supplement 2009, is amended 1 by adding the following new subsection: 2 NEW SUBSECTION . 1A. a. The revenue from the regular 3 physical plant and equipment levy and the portion of any 4 unspent balance in the physical plant and equipment levy 5 fund that is attributable to the regular physical plant and 6 equipment levy as determined pursuant to section 298A.4 may be 7 expended for the following purposes in addition to the purposes 8 described in subsection 1: 9 (1) The purchase, lease-purchase, or lease of computers or 10 computer-related equipment regardless of value per unit, and 11 computer software. 12 (2) The funding of technical support services provided 13 by third-party contractual agreement and technical support 14 training of school district personnel. 15 (3) The cost of the repair of any equipment purchased by the 16 school district under this section. 17 b. This subsection shall not apply to funds received by the 18 school district pursuant to section 423E.4 and authorized to be 19 used for the purposes described in this section. 20 Sec. 2. Section 298A.4, Code 2009, is amended to read as 21 follows: 22 298A.4 Physical plant and equipment levy fund. 23 1. The physical plant and equipment levy fund is a special 24 revenue fund. A physical plant and equipment levy fund must 25 be established in any school corporation which levies the tax 26 authorized, whether regular or voter-approved, under section 27 298.2. 28 2. If applicable, for the school year beginning July 1, 29 2009, the amount of any unspent balance in the physical plant 30 and equipment levy fund that is expended in any one fiscal year 31 for purposes of section 298.3, subsection 1A, shall not exceed 32 an amount equivalent to the ratio of the regular physical plant 33 and equipment levy funds to the voter-approved physical plant 34 and equipment levy funds collected in that fiscal year. 35 -1- LSB 5652SV (4) 83 ak/sc 1/ 2

If applicable, for school years beginning on or after 1 July 1, 2010, the department of education shall require school 2 districts to establish within the physical plant and equipment 3 levy fund a separate account for those revenues derived from 4 the regular physical plant and equipment levy and a separate 5 account for those revenues derived from a voter-approved 6 physical plant and equipment levy in order to ensure that funds 7 expended for purposes of section 298.3, subsection 1A, shall 8 only be expended from regular physical plant and equipment levy 9 revenues. 10 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 11 immediate importance, takes effect upon enactment. 12 EXPLANATION 13 This bill modifies the purposes for which physical plant and 14 equipment levy (PPEL) funds may be used by school districts. 15 The bill expands the authorized uses of the funds to include 16 the purchase, lease-purchase, and lease of computers and 17 computer-related equipment; computer software; payment of 18 technical support, including contractual support and in-house 19 technical support training; and the cost of repair of any 20 equipment purchased with PPEL funds. No funds paid to school 21 districts from the school infrastructure funds pursuant to Code 22 chapter 423E may be used for the purposes of the bill. 23 For the current fiscal year beginning July 1, 2009, school 24 districts with both the regular PPEL and the voter-approved 25 PPEL may not spend more than an amount equal to the ratio of 26 the regular PPEL funds to the voter-approved PPEL funds. For 27 school years beginning on or after July 1, 2010, the department 28 of education must require districts to establish within their 29 PPEL fund, a separate account for revenues from the regular 30 PPEL to ensure only those funds are spent for the purposes 31 specified in the bill. 32 The bill is effective upon enactment. 33 -2- LSB 5652SV (4) 83 ak/sc 2/ 2
